The Issue
We, the undersigned residents and stakeholders, respectfully request that Pacific, Missouri fully comply with the Missouri Sunshine Law (Chapter 610, RSMo) and provide public access to records related to data center projects and municipal decision-making.
Requested Records Include:
All emails, text messages, and other written or electronic communications (including SMS, MMS, Signal, WhatsApp, or other messaging platforms), whether on city-owned or personal devices, sent or received by:
Members of the Board of Aldermen / City Officials
The Mayor
The City Administrator
Any city employee acting on behalf of Pacific, Missouri
For the period: January 1, 2024 – Present
Protective language: This request includes any responsive records created prior to this date that remain in the city’s possession, custody, or control, and communications concerning or referencing:
Data center projects, associated planning, zoning, permits, and related municipal decisions
Any discussions related to decisions, votes, negotiations, or agreements involving these matters
Any memoranda, notes, reports, draft documents, or attachments related to the above communications.
Format & Delivery: We request that these records be provided in electronic format (PDF or native electronic form) and delivered by email if available.
Fees: If there will be any fees associated with this request, please provide an itemized estimate in advance, as required by §610.026, RSMo. If the estimated cost exceeds $50, please notify us prior to fulfilling the request.
Statutory Response Time: As provided by §610.023.3, RSMo, we expect a response within three (3) business days, either by:
Providing the requested records,
Providing a detailed explanation of why the records are closed, including the specific statutory exemption relied upon, or
Providing a reasonable timeline for production.
If any portion of this request is denied, please segregate and provide all non-exempt portions of the records and cite the specific statutory authority for each redaction or denial.
