Our petition, titled "Demand Transparency in Cricket Governance: Bring BCCI Under RTI," highlights the pressing need for transparency, accountability, and the right to information in the operations of the BCCI. Cricket is not just a sport; it's a cultural phenomenon deeply embedded in the hearts of millions of Indians. Decisions made by the BCCI hold immense significance, impacting players, fans, and the entire sporting ecosystem.

Here are the key grounds supporting our demand:

• Public Function Argument: The BCCI exercises quasi-governmental powers in regulating cricket tournaments, selecting national teams, and managing the cricketing ecosystem. Its functions closely resemble those performed by public authorities, necessitating transparency to safeguard public interests.
• Substantial Government Involvement: The BCCI receives various forms of assistance, support, and privileges from the government, including the allocation of land for stadiums, tax exemptions, and the granting of monopoly rights for broadcasting and sponsorship. Such substantial government involvement signifies that the BCCI operates with public funding or assistance, warranting transparency and accountability in its functioning.
• Impact on Public Interest: Cricket in India transcends being just a sport; it's a cultural phenomenon that deeply impacts millions. Decisions made by the BCCI affect players' careers, the sport's development, and the overall sporting ecosystem. Transparency and accountability are vital to safeguarding public interests.
• Corruption Allegations within BCCI: There have been numerous allegations of corruption, nepotism, and favoritism within the BCCI, which have raised serious concerns about the integrity and fairness of its operations. Bringing the BCCI under the RTI Act would enhance transparency and help in investigating and addressing such allegations effectively.
• Corruption Allegations within State Cricket Associations: Several state cricket associations affiliated with the BCCI have also faced allegations of corruption, mismanagement, and financial irregularities. These associations play a significant role in grassroots cricket development and talent scouting, and any corruption within them undermines the integrity of the sport at all levels.
• National Recognition for Cricketers: Cricket is not only a sport but also a source of immense pride for the nation. Cricketers represent India on the global stage and have brought glory to the country through their performances. The recognition bestowed upon them, including prestigious awards like the Bharat Ratna and other national honors, underscores the importance of cricket as a national asset. Therefore, ensuring transparency and accountability in the governance of cricket is essential to uphold the dignity and integrity of these national awards.
• Need for Systemic Reforms: The inclusion of the BCCI and its affiliated state cricket associations under the RTI Act would not only promote transparency but also facilitate systemic reforms within the cricketing ecosystem. This would help in fostering a more transparent, accountable, and equitable environment for the development and promotion of cricket in India.

Now, you might wonder why we are not approaching the Supreme Court directly but instead, seeking action from the Government. The reason lies in the fact that while the Supreme Court can interpret and enforce laws, the initiation of legislative changes falls under the jurisdiction of the Government. By mobilizing public support and pressuring the Government to enact reforms, we can pave the way for lasting change that benefits the entire cricketing community.However, it's important to note that if the government fails to address our concerns adequately or if there are legal impediments in achieving our objectives through legislative means, we reserve the right to approach the Supreme Court for judicial intervention.

We firmly believe that by bringing the BCCI under the purview of the Right to Information (RTI) Act 2005, we can ensure transparency, integrity, and fairness in cricket governance. Therefore, we urge the Government of India to take action and initiate measures to bring the BCCI under the RTI Act, thus fulfilling its commitment to transparency and accountability in all spheres of governance.
