Phoenix VA Police leadership does not need a warning. They already know.
The court orders are being issued. The emails have been exchanged. The deposition schedules are being set. They have been notified, briefed, and included in the correspondence. They cannot claim surprise.
So let us be clear:
- This is not a warning for them. This is a notice for you.
THE "SMALL TOWN" PROBLEM, HIDDEN INSIDE THE FEDERAL GOVERNMENT
In a small town, a local police department or sheriff's office can operate for years with no real oversight. Bad behavior gets hidden. Complaints get buried. Whistleblowers get crushed. The public never finds out because the public is not paying attention.
The Same Problem, Buried Inside the VA
The Phoenix VA Police Department is that small town—except it is buried inside one of the largest federal agencies in the world.
Most Americans Don't Even Know VA Police Exist
Most Americans do not even know that VA hospitals have police officers. And the ones who do?
- They assume those officers - but most of all, Leadership - are held to the same standards as any other federal law enforcement agency.
- They assume there is ("effective") oversight.
- They assume someone is watching.
They would be wrong.
THE "LOWEST POSSIBLE LEVEL" STRATEGY
For years, Phoenix VA Police leadership has handled complaints at the "lowest possible level"—informal conversations instead of documented investigations, quiet words instead of paper trails. The goal was simple:
- Keep the official record clean. If nothing was written down, nothing officially happened.
That strategy worked for years. Until it didn't.
Protected Officials: Substantiated Misconduct, No Consequences
Despite the VA's own Office of Employment Discrimination Complaint Adjudication (OEDCA) finding the department liable for a racially hostile work environment (SEE HERE), certain leadership officials remain in their positions. The VA has knowingly retained individuals with substantiated findings of racial harassment, sexual harassment, and significant misconduct—not just as line officers, but individuals in police leadership roles - as selecting officials who influence hiring and promotions.
This violates EEOC guidelines and the VA's own regulations.
Make Sex & Race Jokes - and Stay in Charge
You can make sex & race jokes in leadership and never face significant punishment. You can still supervise the people you harassed. You can still serve on promotion panels.
The Model of Untouchability
By refusing to act, the VA's Office of Operations, Security, and Preparedness (OSP) and Office of Security and Law Enforcement (OS&LE) have sent a clear message:
- The path to success is not integrity, honesty, or service.
- The path to success is protection.
This is what OSP and OS&LE use as an example of their officers—showing that you can be one of "The Untouchables" too.
The VA's Office of Resolution Management (ORM) has sent notification after notification to the Phoenix VA Health Care System's (PVAHCS) "Executive Leadership" — almost every year since 2022—each one confirming that a "Formal" EEO complaint had been filed and an investigation had begun.
Leadership has received these notifications for more than ten (10) complaints in just the last four (4) years alone. Each one an opportunity to act. Each one met with silence.
THE SWORN STATEMENTS ALREADY EXIST. NOW THEY WILL BE TESTED.
Here is what makes the upcoming depositions different from every internal investigation, every EEO complaint, and every closed-door meeting that came before.
Public Record. Sworn. Unavoidable.
Sworn affidavits already exist in the public record in Ramirez v. Phoenix Veterans Affairs Police Department, No. 2:25-cv-00959-CDB (D. Ariz. filed Mar. 24, 2025).
Nearly three years ago, certain Phoenix VA Police leadership officials made statements under oath in and compelled ORM/EEO investigation in the Ramirez case - and allegedly made false statements, refused to answer questions, and engaged in behavior that is considered a "Lack of Candor." . Those affidavits are public.
- Anyone can read them on the Public Access to Court Electronic Records (PACER).
- Anyone can compare them to what those same officials will say when they sit for their depositions.
Credibility Will Be Tested
Discrepancies will be exposed. Credibility will be tested. And if they lied then, or lie now, the consequences will be real—including potential criminal penalties for perjury.
Rule 30 of the FRCP: No More Hiding Behind the Privacy Act
The department's longtime strategy of avoiding paper trails cannot survive a deposition. Under Rule 30 of the Federal Rules of Civil Procedure, a witness is sworn in, a court reporter transcribes every word, and the transcript becomes a permanent part of the federal court docket. The Privacy Act of 1974 may:
- Shield false statements.
- Protect sworn lies.
But a deposition is a public proceeding. The transcript is evidence. And there is no more hiding behind procedural walls.
- Public. Permanent. Impossible to hide.
THEY WERE TOLD. THEY DID NOTHING.
The blame does not stop with Phoenix VA Police leadership. Above them, two groups (well...technically three) have been fully aware of the "R.O.T." and have done nothing to stop it:
- The Executive Leadership of the Phoenix VA Health Care System itself, along with OSP and OS&LE - the national oversight offices responsible for VA police nationwide.
Since at least 2022, formal EEO complaints have landed on their desks. Notifications have been sent.
Briefings have been held. And yet, the misconduct continued. The retaliation continued. The silence continued.
And here is what they did—or rather, did not do.
The Phoenix VA Health Care System's Executive Leadership
Since at least 2022, PVACHS leadership has received nonstop formal EEO complaints about the VA police. They sat and "ate cheese" with them. They smiled with officials who had substantiated misconduct. They let them sit in on meetings and influence hiring. They ignored it all, waiting for the OSP consolidation to avoid liability.
But it all happened under their watch. Many of these same executives are still facing EEO complaints right now as a result of the Phoenix VA Police misconduct and their own inaction.
OSP and OS&LE: The National Oversight Failure
The OSP and OS&LE have been made aware of these issues. Repeatedly.
They have received notifications. They have seen the EEO findings. They have been copied on complaints. They have been briefed.
And they have....refused to act.
Not because they lacked information. Not because the allegations were unsubstantiated. But because the system protects itself.
Now the depositions will do what internal oversight refused to do:
- Force answers.
WHAT COMES NEXT
The witnesses will be sworn in. A court reporter will transcribe every word. The transcripts will become part of the federal docket—public, permanent, and impossible to bury.
The era of whispered warnings, informal resolutions, and paperless investigations is ending.
- The depositions are coming. The depositions are coming!
Phoenix VA Police leadership knows it. OSP knows it. OS&LE knows it. PVAHCS knows it.
But the public does not. And that is why we are sounding the alarm—not for them, but for you.
Because the only thing that changes a system built on secrecy is "sunlight." And the depositions are about to let the sun in.
THE BOTTOM LINE
This is not a warning for the powerful. They already know.
This is a notice for the public. Because most Americans have no idea what has been happening inside their VA police departments. And the only way that changes is if enough people start paying attention.
Read the public docket. Watch the depositions. Demand accountability from OSP and OS&LE.
The badges that are considered "Untouchable" are now within reach of a "subpoena."
