Demand that Region 2000 Services Authority Pay $6.1 MILLION Owed to Campbell County
The Issue
This petition is to demand the immediate release and payment of $6.1 MILLION to Campbell County, for the Excess Revenue fees collected and withheld by Region 2000 Services Authority.

Region 2000 Services Authority, a non-elected government entity, is withholding $6.1 Million from the taxpayers of Campbell County by refusing to distribute host fees due to Campbell County and its residents. The Authority is comprised of four member jurisdictions: Campbell County, Lynchburg City, Nelson County, and Appomattox County.
History:
- Campbell County entered into the Region 2000 Services Authority in 2008 and began accepting waste at its Livestock Road location in 2012
- Since 2009 "Excess Revenue" has been collected by charging $10 more per ton from its private haulers and returning these amounts back to the host localities
- Since 2018, the Authority has continued to collected over $8M from its private haulers, but refuses to pay the host landfill, Campbell County
- Campbell County has been in litigation since 2000 with no resolution on this matter, other than an offer to expand operations for 30 years in exchange for payment in full which majority of the citizens are adamantly against
The amount of $6.1M is divided into 2 portions:
(Note: these amounts do not include interest)
Excess Revenue (Airspace Reserve) prior to September 2021 - $2,842,991.96 (as of 9/30/2024)
- This amount accumulated from July 2018 through September 2021.
- Excess Revenue distributions were derived from the commercial waste received and divided between Lynchburg and Campbell based upon the amount of air space each provided to the regional entity (30.6% to Lynchburg; 69.4% to Campbell)
- Distribution of these funds requires a vote from the board
- Appomattox and Nelson have voted against the distribution of these funds since 2019
Excess Revenue after September 2021- $3,279,495.84 (as of 9/30/2024)
- Under the Region 2000 Services Authority's current financial policy, 75% of Excess Revenue money was to be distributed by the Authority to Campbell County, the landfill host.
- Region 2000 Services Authority currently claims that a vote from the Board of Directors is required to distribute these funds when in fact this is not true per their own financial policy and their own legal counsel
- Region 2000 legal counsel William Hefty disclosed to the board in a Memo dated June 8, 2021, that....
"It is my opinion that the administration should follow the policy adopted by the Board and distribute the Excess Revenue collected after September 1 (2021). A vote of the Authority is not annually required to specifically distribute the funds, as the policy states that the Authority “will” distribute the amount as specified." - Bill Hefty
- Under this assumption, the management of Region 2000 Services Authority has the authority to issue this payment immediately, but refused to do so.
Region 2000 has these withheld funds ($6.1 Million) available and listed on the Balance Sheet in a Restricted Fund. Region 2000 has the cash available, but as of this date, no funds have been distributed.
