The Issue

In Tennessee today, women's health rights are under significant threat due to the near-total ban on essential abortion care. This restrictive law, with very limited exceptions, puts lives at risk and diminishes the ability of women to make decisions about their own healthcare. The absence of exceptions for cases like rape or incest highlights the inflexibility and extremity of the current policies.

 

Under Tennessee law, performing an abortion is classified as a Class C felony for medical providers, subjecting them to prison time. Remember it can occur naturally as a "spontaneous abortion" commonly called a miscarriage . This not only criminalizes healthcare professionals but also obstructs safe and legal access to necessary medical procedures for women across the state. Moreover, patients are faced with unnecessary burdens, such as the requirement to make multiple trips for counseling and procedures, and to undergo medically unnecessary ultrasounds.

 

Tennessee's state constitution explicitly excludes abortion rights, leaving women to seek care through telehealth from states with shield laws or to travel out of state. These barriers disproportionately affect those who are economically disadvantaged, creating a system of inequality in healthcare access. Furthermore, the ban on state Medicaid and specific private health insurance coverage of abortion care further limits access for those in need.

 

Only physicians are permitted to provide these services, blocking qualified healthcare professionals from stepping in. This lack of flexibility adds strain to an already overburdened healthcare system and restricts timely access to care. It is crucial that we demand change to protect women's health, autonomy, and rights in Tennessee.
