We, the undersigned residents of Surprise, Arizona and surrounding communities, are petitioning to have the illegal actions committed by Surprise City Council Member Alyson "Aly" Cline.

Since the month of March this year (2024), Councilmember Cline has been observed on several occasions violating City, State, and potentially even Federal laws. The known events thus far are as follows:

• MARCH 15, 2024: Councilmember Cline is seen using city resources and her official title/position to campaign and influence election outcomes at one of her monthly community/constituent meetings.

• MARCH 27, 2024: Councilmember Cline is seen tearing down signs covered under the First Amendment and also signs that were intended to help get her opponent for the Surprise Mayoral Race on the ballot.

• APRIL 26, 2024: Councilmember Cline is seen again using city resources and her official title/position to campaign, disparage and discredit her opponent, and influence election outcomes at one of her monthly community/constituent meetings.

• MAY 3, 2024: Councilmember Cline is seen online participating in a Mayoral Debate/Forum sponsored by the Northwest Valley Chamber of Commerce wearing a City of Surprise polo shirt, which is further establishing a pattern of using city resources to influence election outcomes.

With Mrs. Cline's actions there are several legal impacts, which I mentioned before. Below are the known legal violations/impacts thus far:

• City of Surprise Policies & Procedures Manual - Councilmembers are prohibited from participating in any activity that could even appear as a conflict of interest.
• City of Surprise Employee Policy Manual - Use of an employee's official position of duties with the City of Surprise for that employee's own personal interest, benefit, gain, or inappropriate influence is strictly prohibited and will not be tolerated.
• Surprise Municipal Code (SMC) Sec. 109-1.17 - Items A, B, C, & E outline the authority of code enforcement, notice of violation, delivery of notice, and removal of signs. 
• Arizona Revised Statutes (ARS) 9-500.14 - Item A lists out that a city or town shall not spend or use its resources for the purpose of influencing the outcomes of elections.
• Arizona Revised Statutes (ARS) 16-192 - Item A lists that notwithstanding any other law, this state and special taxing districts and any public agency, department, board, commission, committee, council, or authority shall not spend or use public resources to influence an election.
• Arizona Revised Statutes (ARS) 16-1019 - Item A lists that is a Class 2 Misdemeanor for any person to knowingly remove, alter, deface, or cover any political sign.
• Arizona Revised Statutes (ARS) 38-504 - Item C stipulates that a public officer or employee shall not use or attempt to use their official position to secure any valuable thing or valuable benefit to that individual. 

OUR DEMANDS FOR THIS PETITION ARE AS FOLLOWS:

1. Conduct a thorough investigation into Alyson "Aly" Cline's actions on the aforementioned dates, and any other activities as more come to light that are in violation of any sort of policy/procedure, municipal code, state statute, or other legal item / laws.
   
   
2. If found guilty of violating the laws, codes, policies/procedures, etc., demand appropriate consequences as per legal guidelines, case law, and/or legal precedent.
   
   
3. Advocate for transparency, integrity, and ethical conduct within the local government to restore public trust and take appropriate actions to prevent future misconduct.

We implore the relevant legal authorities to take swift and decisive action to address the illegal actions of Alyson Cline. Upholding legal and ethical standards in public service is crucial for the overall well-being and trust of our community within the City of Surprise.
