Demand major reform of VAWA immigration benefits
The Issue
PETITION: Demand Major Reform of VAWA Immigration Benefits and Stronger Safeguards Against Abuse of the System
To: The United States Congress, the U.S. Department of Homeland Security, and U.S. Citizenship and Immigration Services (USCIS)
Our Demand: Accountability, Transparency, and Immigration Integrity
We, the undersigned, call upon the United States government to conduct a comprehensive review of the immigration-related provisions of the Violence Against Women Act (VAWA), with the goal of ending or fundamentally restructuring the use of these provisions as a pathway to immigration status when they are exploited through fabricated allegations, deliberate manipulation, or fraudulent claims.
VAWA was established to protect individuals who have experienced domestic violence and abuse. Genuine victims deserve protection, dignity, and access to justice. However, laws designed to protect vulnerable individuals must also contain meaningful safeguards against those who may attempt to exploit them for personal or immigration-related gain.
There are individuals who may enter relationships with immigration benefits in mind, manipulate conflicts, provoke confrontations, or selectively document incidents in an effort to portray themselves as victims. When allegations are knowingly fabricated or evidence is deliberately manipulated to obtain immigration benefits, the consequences can be devastating for the accused partner, their children, and their families.
A person who experiences false allegations may face emotional distress, reputational damage, legal expenses, family separation, and lasting consequences. Children can also be affected when conflict between parents escalates into allegations, legal proceedings, and prolonged family instability.
No law intended to protect victims should be beyond scrutiny, accountability, or reform.
What We Are Asking the Government to Do
We respectfully call upon Congress and the appropriate federal agencies to:
Review and end or fundamentally restructure VAWA's immigration self-petition pathway. Congress should examine whether these immigration benefits should continue in their current form and consider ending this pathway or replacing it with a framework that provides meaningful protections against exploitation and fraud.
Strengthen safeguards against knowingly false claims. Establish appropriate procedures to identify and investigate credible evidence of deliberate fabrication, material misrepresentation, or intentional manipulation in immigration proceedings, while recognizing that an unsubstantiated allegation is not automatically a false allegation.
Require rigorous, fair, and impartial case reviews. Ensure that immigration decisions are based on a careful assessment of credibility, consistency, relevant evidence, and the circumstances of each individual case, with appropriate protections for the privacy and safety of genuine survivors.
Establish meaningful accountability for proven immigration fraud. Where intentional fraud is established through lawful procedures, apply appropriate consequences consistent with federal law, including review of immigration benefits when legally justified.
Protect families and children from the consequences of deliberate manipulation. Encourage coordination, where legally appropriate, between relevant authorities when credible evidence of fabricated allegations or related misconduct emerges, without allowing immigration proceedings to compromise legitimate child-safety protections.
Increase transparency and public accountability. Publish appropriate, privacy-protective information about fraud investigations, findings, and program integrity so the public can better understand how the system is administered.
Why This Matters
Immigration laws and domestic violence protections must operate with fairness, integrity, and accountability. Genuine survivors should never be forced to remain in abusive relationships because they fear losing their immigration prospects. At the same time, people should not be subjected to knowingly fabricated allegations or deliberate manipulation of legal protections for immigration advantage.
The public deserves confidence that humanitarian immigration programs are serving their intended purpose and that credible evidence of misconduct is taken seriously.
This petition is not a demand to dismiss genuine survivors or assume that every VAWA applicant is dishonest. It is a demand for meaningful scrutiny of the immigration system, stronger protections against deliberate exploitation, and a serious examination of whether the current immigration provisions should continue.
Our Final Request
We urge the United States Congress to hold public hearings, examine documented cases of suspected abuse of the immigration process, consult legal experts and affected families, and introduce legislation to end or fundamentally reform the immigration benefits available through VAWA.
We call for a system in which protection is available to those who genuinely need it, fraud is investigated fairly, and no individual is permitted to exploit humanitarian protections without accountability when misconduct is proven.
Sign this petition to demand immigration reform, stronger safeguards against fraud, and a fairer system that respects the rights and dignity of everyone involved.
Protect genuine survivors. Prevent deliberate exploitation. Demand accountability and justice.
