Demand Justice Alito Recuse Himself from January 6 Cases

The Issue

As a retired Legal Aid attorney who has spent a lifetime fighting for equal access to, and application of, justice, I am deeply concerned by Supreme Court Justice Samuel Alito's actions.

Flying the American flag upside down over his home, as well as flying the "Appeal to Heaven" flag, carried by many of the Capitol marauders, over his vacation home, are clear signals of support for Donald Trump, the far right wing, and the other insurrectionists involved in the January 6, 2021 attack on our democracy. These actions by Justice Alito, create an unequivocal perception of bias and are clear violations of judicial ethics that require his recusal from all cases related to the insurrection.

According to the American Bar Association's Model Code of Judicial Conduct there are four canons of conduct that judges shall follow:

Canon 1 states that "[a] judge shall uphold and promote the independence, integrity, and impartiality of the judiciary, and shall avoid impropriety and the appearance of impropriety."

Canon 2 of the Code states that "[a] judge shall perform the duties of judicial office impartially, competently, and diligently."

Canon 3 requires that "[a] judge shall conduct the judge’s personal and extrajudicial activities to minimize the risk of conflict with the obligations of judicial office."

And Canon 4 of the Model Code of Judicial Conduct notes that "[a] judge or candidate for judicial office shall not engage in political or campaign activity that is inconsistent with the independence, integrity, or impartiality of the judiciary."

Justice Alito is in violation of all the provisions of the American Bar Association's Model Code of Judicial Conduct. He has acted with complete disregard of, and disdain for, the rules that all other judges must follow. His actions in flying symbols of the insurrection are improper, biased, and unethical and render him unable to impartially rule on any case related to the January 6th insurrection. Thus, Justice Alito must recuse himself from all such cases.

It is imperative that our judiciary, and particularly, our Supreme Court, remains impartial and upholds the highest standards of integrity.
