On February 14, 2025, due to County Judge Roane's refusal to comply with
the request to view the video footage, the District Attorney's office filed a Grand JurySubpoena for the video footage. 

IT member Darrell Hoberer was given the subpoena for the video footage. After he was presented with the subpoena, he again asked County Judge John Roane if he could comply. Again, even though the District Attorney's office is unaware of any authority the County Judge Roane has over the video footage, District Attorney John Warren and First Assistant Eric Erlandson met with County Judge John Roane and Darrell Hoberer in Judge Roane's office.  The District's Attorney's office asked to see video footage because they believe a criminal act was committed during the time requested. Judge Roane asked the District Attorney what they were looking for on the videos. He asked if this investigation was for the "Newberry side or the otherside." Judge Roane stated that he wanted to speak with an outside attorney concerning the request and would wait until Tuesday to make his decision on whether he would allow the District Attorney to see the video. Mr. Hoberer indicated that he was willing to comply with the subpoena but needed to wait for permission from Judge Roane. However, after the meeting, Darrell Hoberer checked the video system and informed the District Attorney's office that the video footage was no longer available and had an error code showing all footage from February 10, 2025 and before was no longer able to be recovered.

 District Attorney John Warren met with County Judge John Roane on
February 18, 2025, to discuss the release of the video footage to the District Attorney's Office. In the meeting, Judge Roane stated that he would turn it over only if there was a court order that ordered him and was signed by an "outside" judge. District Attorney Warren is filing this Motion to Compel to obtain an order.
Production of the video footage is necessary for the District Attorney's
office to conduct its investigation.
 To date requests have been denied and a Grand Jury Subpoena has been
ignored. All without cause.

Haverkamp has not stepped down yet and Current Judge Presiding has given permission for her to still give legal advice on all cases but not actively preside over...
