Demand ICE Follow a Federal Judge's Order in Colorado
The Issue
A federal judge in Denver says U.S. Immigration and Customs Enforcement (ICE) broke his court order in at least three Colorado arrests. He has laid out what should happen next: the agents involved in two of those arrests should be sanctioned, both men should be released if they are still being held, and the government should cover the medical bills of an 18-year-old who was hurt. ICE and the Department of Homeland Security (DHS), which oversees it, need to follow through.
The teenager, named in court only by his initials, was riding to work with two relatives last month when agents pulled him from a truck at a 7-Eleven. A man arrested with him said in a sworn statement that an agent beat the teen on the ground. Photos filed in the case show a black eye and cuts on his forehead, and the filings allege his wrist was broken. DHS lawyers say the truck struck an ICE vehicle. The two men say they were backing out to leave and bumped something lightly. Judge R. Brooke Jackson wrote that agents "assaulted" the teen, according to The Denver Post.
In a separate stop, agents pulled over the wrong man and went ahead with the arrest after he told them the warrant named a different person. "The mistaken identity was not reasonable, the follow up conduct was not reasonable, and the warrantless arrest violated the Court's enforcement order," Judge Jackson wrote, according to The Denver Post.
Twice now, the judge has told ICE in Colorado to get a warrant first, or to follow set steps to decide whether an arrest is truly needed. He also found that ICE has not handed over records the court required. Whatever someone believes about immigration policy, federal agents have to obey the courts like everyone else.
Sign the petition to tell ICE and DHS to follow the judge's order now, before anyone else in Colorado is hurt or wrongly arrested.
