Demand Harsher Punishments for Sexual Offenses in Idaho

The Issue

I am one voice among many, advocating for change because every 68 seconds, an American is sexually assaulted, every 9 minutes, that victim is a child. The chilling reality is that only 25 out of every 1,000 perpetrators will end up in prison.
In Idaho — where I call home — there are currently 5,268 sexual offenders, with that number rising daily. When change appears impossible, here is where I choose to begin.

FIRST: Mandatory minimum sentences for rape crimes in Idaho remain disappointingly lenient — a minimum of only 1 year — the other 9 statutes — ZERO minimum—further encouraging a culture that undermines the severity of these heinous acts. Our aim is to oppose the current minimal sentences and advocate for the minimum sentencing to be increased to a term of no less than 5 years.

SECOND: We are also calling for a change to Idaho’s Criminal Rule 11. Pleas. Section (f) (1) (A) in regard to sexual offense. NO move for dismissal of other charges. 

The current laws facilitate a system where the scales are tipped unduly in favor of the perpetrators, thereby failing to sufficiently protect and provide justice to the victims. This inherently discredits the traumatic experiences victims endure and dismisses the lasting psychological and emotional impacts of these violations.

THIRD: If a parent is a registered sex offender, there is a strong presumption against granting them custody of a child, meaning the court will generally not award custody unless it is proven beyond doubt that the child would not be at risk; this is based on the "best interests of the child" standard, and the sex offender parent would need to demonstrate significant evidence to overcome this presumption. 

The aim of my petition is to recalibrate these scales — to bring about laws that sufficiently penalizes the heinous actions of perpetrators, and in doing so, send out a clear message: we the people of Idaho, will not tolerate these disgusting acts. . Sexual offenses must be regarded with the utmost severity, and our legal system must reflect this by enforcing harsher punishments.
