The Issue

In the heart of Perth and Kinross, I recently found myself on the wrong side of a parking charge notice (PCN) issued by Group Nexus. While my vehicle, unfortunately, broke down in one of their car parks, I was faced with an unwarranted fine and a dismissive response—"tough luck, it's in the terms and conditions, deal with it." However, under Scottish law, if your car breaks down in a car park, you are not legally required to pay a parking ticket. This law provides a strong ground for appeal if a ticket is issued while the vehicle waits to be fixed or towed, a provision clearly overlooked by Group Nexus and, disturbingly, by the British Parking Association (BPA).

This oversight is not just a minor inconvenience; it's a breach of the rights provided to Scottish drivers. Group Nexus, a private car parking company operating widely, fails to incorporate Scottish legal provisions into its regulations, even though laws are in place to protect individuals in such situations.

This petition calls for immediate action to rectify this discrepancy. We demand that Group Nexus ceases all their parking enforcement activities across Scotland until the BPA amends its guidelines to include Scottish laws. This adjustment will ensure fair treatment for all motorists who find themselves in unfortunate circumstances beyond their control.

Furthermore, we insist that any active PCNs issued under these incorrect regulations be rendered invalid. Scottish drivers should not bear the burden of regulatory oversights by private parking organizations.

Our goal is simple yet critical: align private parking enforcement practices with current Scottish legislation. This change will not only benefit me, as someone wrongfully ticketed, but also countless others who could find themselves in similar predicaments.

Support this cause for justice and fair play. Sign the petition today to push for changes that respect Scottish laws and protect innocent drivers from unjust penalties.
