The Issue

We, members of the Bar, are writing to lodge our strong protest, and consequently demand your resignation for the blatantly partisan, illegal and unconstitutional actions carried out by you throughout your tenure, which have recently taken unprecedented proportions. Such actions clearly demonstrate that not only are you unfit to occupy the high office that you sit in, but in fact also calls into question your very fitness to remain a senior lawyer.  

          Most pertinently, your abuse of the office of the Chairman of the Bar Council, which has caused tremendous outrage even among the general public, has been the issuance of Letter No. BCI:D:5449/2026 dated 13.08.2026, in which, besides making intemperate and partisan remarks in complete derogation of multiple constitutional principles, you had illegally directed a blanket ban on the enrolment of all students of the National Academy of Legal Studies and Research University of Law (NALSAR), Hyderabad. It was well evident that you had sought to destroy the careers of hundreds of these students and put the future of this country under grave jeopardy, ostensibly at the instance of your political backers and masters. The fact that you had to immediately issue a further letter, bearing Letter No. BCI:D:5450/2026 dated 13.08.2026 on the same day, withdrawing such illegal directions, points towards the fact that it is only due to the public outcry and potential upheaval that you were forced to back down from your attempts to put into motion the illegal directives issued to you by the ruling dispensation. The extent of your failure on this issue is exemplified by the fact that Hon’ble the Chief Justice of India was also constrained to comment that “Who is the Bar Council of India to come between the students and me? The Bar Council of India has no business here … It is a dialogue between the students and me. Why is the BCI unnecessarily interfering”, as reported in the news.

          Some of your deliberate acts which have led to attraction of disrepute towards the legal profession, and embarrassment to the esteemed organization of the Bar Council of India, are as follows-

i.                   As highlighted by other members of the Bar, you had issued a earlier letter bearing BCI:D:4882/2016 (Council-Ch), addressed to the Hon’ble Prime Minister of India, in a language indicating a servility of the Bar Council of India to the Prime Minister, including repeated utterances of “My Lord!”. The letter had also tended to surrender the jurisdiction of the Bar Council of India, an independent statutory body constituted through elections, to the Prime Minister of India. The letter also contained references to the political maneuvers of the Chairman. 

ii.                 You had also issued a press release dated 29.09.2018 on the issue of post-retirement posts for retiring Supreme Court Judges, and thereafter had issued a completely contrary and clearly political view in a press release dated 18.03.2020 upon the nomination of Hon’ble Mr. Justice Ranjan Gogoi (Retd.) to the Rajya Sabha. 

iii.              In a further instance of the misuse of your office you had issued a statement concerning the allegations of sexual harassment against the then Chief Justice of India. 

iv.              You had made baseless claims in the public that 40% of advocates had fake degrees, maligning the reputation of the legal fraternity, and bringing a clout over hardworking advocates engaged in serving the public. You made such comments without any inquiry or evidence, and without accepting accountability, as Chairman of the Bar Council of India.

v.                 While the entire legal fraternity across the country had stood against, and agitated against, the introduction of the Advocates (Amendment) Bill, 2025, for its intended impact on the independence and integrity of the Bar, you, by your comments and directives on the agitating advocates at the time, had sought to give support and credence to the attempts of the Government to intrude into the governance of the profession. 

vi.              The extravagant expenditures of the Bar Council of India under your leadership have also been highlighted by members of the public.

vii.            More recently, you had also issued a press release dated 23.07.2026 titled “An Appeal to the Intellectuals of the Country”, stated to be in your capacity as Chairman of the Bar Council of India, against the student protests which were then ongoing in the Country. 

viii.         You had also recently failed to protect the independence of the Bar by affirming the directions of the Hon’ble Supreme Court regarding co-option of women members in State Bar Councils by Chief Justices of the respective High Courts.

          It is well evident that you have utterly failed in the discharge of your statutory functions, and you consequently stand denuded of the right to hold office. Your presence at the Bar Council of India is bringing down the legal profession in the eyes of the entire world, and most importantly among the citizens of India, whom the members of the Indian Bar have been tasked to serve. The high esteem in which the Indian Bar is held, owing to its glorious history of more than two-hundred years of service to the nation, including its role in the Freedom Movement, remains under serious threat due to your actions. Without commenting further on your evident lack of capabilities or intentions, please quit in the interest of the Bar to which you owe a lot for the great advantages and benefits it has given you in your life.
