Demand for Gender-Neutral Laws and a National Men's Commission in India

The Issue

Why This Petition Matters:

In a society built on the principles of justice, equality, and dignity, no law should favor one gender over another. While India has made remarkable progress in protecting the rights of women, it has ignored the silent suffering of men, who are increasingly becoming victims of legal misuse, societal neglect, and emotional trauma.

When gender-specific laws like IPC 498A (Dowry), Domestic Violence Act, POSH (Workplace Harassment), and others were enacted decades ago, women were mostly confined to homes, with little societal power or financial independence. At that time, the laws were necessary — and even today, protecting women against real abuse must continue.

 

But it is now 2025. Society has changed. Women today are empowered, working, and independent — and many are now misusing these protective laws as weapons against men for personal, financial, or emotional revenge. Unfortunately, the law has not evolved with society, and the result is deep, irreparable damage to countless innocent men and their families.

 

Here Are Some Reasons Why India Needs Gender-Neutral Laws Now:

 

Legal Misuse and Injustice

1. IPC 498A (Dowry Law) is being misused in over 70% of cases, as per NCRB reports.

2. False accusations lead to instant arrest without investigation.

3. Entire families including elderly parents and even pregnant sisters are jailed under one complaint.

4. Bail is often delayed, making arrest a punishment before trial.

5. No penalties exist for filing false cases in most situations.

6. The accused is presumed guilty until proven innocent — violating basic human rights.

7. Laws like Domestic Violence Act are one-sided, allowing only women to file complaints.

8. Men are not legally recognized as victims of domestic abuse, even if they are tortured or assaulted.

9. Legal aid and help centers ignore male victims completely.

10. POSH (Workplace Harassment law) allows for immediate termination of male employees even before guilt is proven.

5. Launch mental health support programs for male victims.

6. Create shelters and helpline services for abused or harassed men.

7. Ensure fast-track courts for cases involving false allegations.

8. Mandate equal child custody and parenting rights for fathers.

9. Collect and publish real data on male suicides related to false cases.

10. Promote the concept that “Justice has no gender” — all victims matter.
