My name is Medhavi, and I am a third year law student. The recent events have shaken many of us deeply. While I believe protests and public voices are necessary, I also believe that we need to look at the legal changes that can make our justice system more consistent.

I am therefore starting a petition calling for a more uniform and structured sentencing policy in rape cases in India.

At present, similar cases can sometimes result in very different sentences. Of course, every case has its own facts and judicial discretion is necessary. I am not suggesting that judges should be bound to impose identical punishments in every case.

However, there should be clearer sentencing guidelines and minimum thresholds for particularly serious circumstances. This could include establishing clearer circumstances in which life imprisonment should be the minimum sentence, while still allowing judicial discretion in exceptional cases. The objective is to ensure that similarly placed cases do not result in vastly different punishments without a clear and legally justifiable reason.

The aim is simple: to retain judicial discretion while making sentencing more consistent, transparent and proportionate to the gravity of the offence.
