The Issue
My children mean the world to me. In a bitter battle for custody, often, aspects such as character come into play. Unfortunately, these aspects are often overlooked or are not sufficiently substantiated. Evidence of character, demonstrated through character references, can be a critical element in custody cases. They can help provide a more rounded view of an individual’s capacity and suitability as a parent.
Sadly, many regions and court systems do not have standardized processes for assessing character in custody hearings. This neglect of character assessment denies judges the full picture, potentially leading to biases and injustices in decisions. It is high time that courts consider character assessment as an integral part of their review process, weighted with the meticulous attention it rightfully deserves before granting custody.
The UN Convention on the Rights of the Child, Article 3, highlights the best interests of a child should be a top priority in all actions concerning the child. A child’s best interests are served by ensuring they are cared for by a responsible, loving, and dedicated parent, factors that can be significantly underlined by character references.
Therefore, we urge courts and legislators to enact regulations that require proof of character in child custody court proceedings. It is paramount that decisions made in child custody cases are comprehensive, fair, and grounded in the best interest of the child.
