The Issue
Thousands of Arizona families are being forced to choose between their home and their dog. A bill that would fix that is being blocked by one senator who won't even explain why.
HOA rules that ban certain dog breeds or restrict pets based on weight are not grounded in evidence. They are arbitrary policies that tear families apart. When a family moves into a community unaware that their dog is prohibited, they face an impossible choice. Shelters across Arizona are seeing the consequences. Housing restrictions are one of the most commonly cited reasons families surrender their pets.
SB 1582 would make clear in Arizona law that HOA rules limiting dogs based on breed, size, or weight are invalid. HOAs could still set reasonable rules about the number of pets and their behavior in shared spaces. What they could not do is ban a family from keeping their dog in their own home.
The bill passed the Arizona House 47-7. It has bipartisan support in the Senate. The organizations that represent HOA managers are not even opposed to it.
But Senator Jake Hoffman, who chairs the Senate Government Committee, has blocked this bill twice without explanation — once as HB 4017 and once as SB 1729. He has refused to give either a hearing. And he has told colleagues he believes GOP leadership will prevent a floor vote even through a procedural workaround.
One senator should not be able to override the will of 47 House members and keep Arizona families separated from their pets.
