The Issue
In Colorado, I am personally facing the daunting challenge of seeking justice amid a system that shields certain individuals from accountability. My situation involves an appraiser who allegedly committed fraud and has pleaded guilty before the Department of Regulatory Agencies (DORA) and was sanctioned harshly for his violations. However, due to the system of immunity, not only is the DORA record sealed without a subpoena, but the courts are also preventing me from bringing a lawsuit against this appraiser. This cloak of immunity is obstructing my pursuit of justice and, distressingly, it's not limited to just my case.
Judges, court-appointed experts, and witnesses in Colorado are currently granted absolute immunity for their professional actions. This immunity implies that even if they engage in intentional misconduct, those affected have no recourse to seek justice under the current legal setup. While proponents of this system argue that such immunity is necessary to ensure unbiased judicial processes, it inherently exposes a dangerously unregulated realm where illegal activities and negligence can occur unchecked.
If this problem sounds familiar, it's the base of the pillars that we need to knock down with the No Kings movement. Nobody is above the law. Nobody can spend millions to have a little tank show. Nobody can break the law because of immunity. We must be a system of fairness and equality
The pressing need for reform in our judicial system is clear. By removing or limiting the absolute immunity granted to judges and court-appointed personnel, we can pave the way for accountability and protect the constitutional rights of individuals impacted by potential judicial and professional misconduct. Instances of civil rights violations, deviation from state statutes, invalid legal procedures, and blatant misuse of judicial privilege as are clearly evident in my cases should never go unchallenged.
Colorado deserves a judicial system that holds every member to the same standards of accountability. Let’s work together to foster a legal environment that prioritizes transparency, justice, and equality for every citizen of Colorado.
