We, the undersigned, are deeply troubled by the widespread reports of construction defects, poor building materials, subpar craftsmanship, and inadequate customer service experienced by homeowners who have purchased homes manufactured by Clayton Homes.
Specifically, we are concerned with the alarming lack of accountability and ethical practices exhibited by Clayton Homes, its dealers, state inspectors, and regulatory bodies such as HUD.
These examples are just a few of many that highlight a disturbing pattern of neglect and disregard for consumer rights within the manufactured housing industry that demands immediate attention and action.
Inadequate Repairs and Negligent Service: Numerous homeowners have reported instances where Clayton Homes failed to honor repair appointments or sent unqualified personnel, unable to address critical issues like roof leaks, foundation issues, and siding problems. This lack of accountability and professionalism is unacceptable.
Violation of Warranty and Substandard Workmanship and Installation:
Homeowners have discovered faults in essential components such as
~ridge vents were installed improperly, leading to leaks and other structural issues.
~Grading and footers not being correctly done to divert water from under the home leading to pooling water, mold issues and sinking footers causing structural issues such as cracked ceilings.
~Plumbing and drainage issues such as French drains & sewer pipes being run up hill and away from the septic systems.
~Incorrect anchors and straps used to tie down homes.
Systemic Quality Issues: Reports of multiple defects, including crooked walls and windows, bowing siding, sagging floors, and malfunctioning HVAC systems, indicate systemic failures in construction and quality control. These defects not only compromise the structural integrity of the homes but also pose serious health and safety risks to occupants.
Mold, Water Intrusion and Health Hazards: Many homeowners have discovered extensive mold growth due to faulty installations, inadequate roofing, and plumbing issues. Mold (and water) has been found in insulation, walls, floors, and even underneath the home's structure, leading to significant health concerns for residents. Mold-related complaints range from water leaks causing mold growth to improper HVAC installations resulting in persistent moisture issues which have led to sickness of homeowners to death of their beloved pets.
The experiences described above are not isolated incidents but reflect a broader failure within the industry to uphold basic standards of quality, integrity, and consumer protection.
Despite being covered under warranty, and repeated attempts to seek resolution, Clayton Homes has unjustly denied claims, citing baseless reasons such as settlement issues unrelated to the homeowner's actions.
Clayton Homes has demonstrated unethical practices and a disregard for customer well-being and safety. It is unacceptable that the leading manufactured home company in America is allowed to operate with such impunity.
To make matters worse, Regulatory agencies such as the Department of Commerce and Insurance and HUD have been summarily closing cases without the fundamental issues being adequately addressed or corrected.
Therefore, we demand the following actions:
Immediate Remediation: Clayton Homes must promptly address outstanding repairs and honor warranty claims without unjustified delays or denials, particularly those related to mold remediation and prevention and health and safety concerns.
Accountability: Hold Clayton Homes and its affiliated dealers accountable for ensuring quality material, construction, proper installation, and timely resolution of customer complaints. Implementing heavy fines for non-compliance.
Transparency & Implementation of Stricter Inspection Requirements: Call upon state inspectors and HUD to conduct thorough and rigorous inspections, ensuring compliance with safety standards and regulation. Enforce prioritizing issues related to mold contamination and health and safety hazards.
Ethical Practices: Implement and enforce ethical business practices across all aspects of manufactured housing operations, including construction, inspection, and customer service.
Industry Reform: Implement stringent measures to hold manufacturers and dealers accountable for substandard construction practices that contribute to mold growth and other health and safety risks.
