Dehumanizing comments made by radio personality 'On Air'

Jenna Talackova stated that she was born with male anatomy but identified as female from the age of 4, started female hormones at 14 and had gender reassignment surgery at 19. She has a female birth certificate, I.D. Passport and drivers license making her anatomically and legally as female as any other woman in the world with the same legal rights and privileges as any other woman.

In the radio broadcast on Highveld Stereo 94.7, a radio station in Johannesburg, South Africa, the presenter and co-host were commenting on similar articles as featured in the media around this time and questioning where she hid her 'male' bits when parading in a bathing costume and referred to her as an 'It'.

We as a community find it unacceptable that people in prominent and influential positions are allowed to make statements, report on events and omit information or distort the information in such a way that it discredits us as human beings, and refer to us in derogatory, dehumanizing terms such as 'It', instead of the gender we are legally listed as, male or female, in order to create a sensation. This message is conveyed to their entire listener base of millions of people within seconds and creates a negative perception and stereotype of our whole community, who also form a part of that listener base.

The BCCSA has a code of conduct which states:
Paragraph 4.2 ( c )
Broadcasting services Licensees must not broadcast material which, judged within context amounts to (C), the advocacy of hatred that is based on Race, Ethnicity, Religion or Gender and that constitutes incitement to cause harm.
(The Transgender community is subject to hate crimes on a daily basis and comments like this serve to fuel that hatred in the general public.)
Paragraph 11
11.1 Broadcasting services Licensees must report news truthfully, accurately and fairly.
11.2 News must be presented in the correct context and in a fair manner without intentional or negligent departure from the facts, whether by;
(a) Distortion, Exaggeration or misrepresentation.
(b) Material omissions.
(c) Summarization.

The Constitution of South Africa, Act No. 108 of 1996:
Sub section 9, Equality
9.4 No person may unfairly discriminate directly or indirectly against anyone on one or more grounds in terms of subsection (3). National legislation must be enacted to prevent or prohibit unfair discrimination.
(3) The state may not unfairly discriminate directly or indirectly against anyone on one or more grounds, including race, gender, sex, pregnancy, marital status, ethnic or social origin, color, sexual orientation, age, disability, Religion, conscience, belief, culture, language and birth.

We as a community work extremely hard to change the negative perceptions and stereotypes that people have about us and incidents like this effectively destroy years of hard work on our side.

We ask that the BCCSA enforce its code of conduct more strictly in this respect and send a message to the parties involved that this is unacceptable conduct on their part, and we as a community will not tolerate being dehumanized in this way.
