QUESTIONNAIRE

1. Somebody property or land marked with a geographical indicators (style) as land marks. Can
the indicator be removed? Can a private surveyor subdivide a land already partition by
government surveyor allowed by the court of law; can he/she be charged by court of law?
2. If someone makes economical farming activity illegally and a court has disapproved
ownership, can the economic statistic data be changed in favour of the legal owner like tea,
coffee, or any other economic crops?
3. Where a shopping centre was built illegally, without construction and procurement laws on
somebody’s land, does a court of law have mandate to stop or cancel any license of trade?
How does World Trade Organization take action?
4. A hospital built on land against the legal owner permission or knowledge; can a court of law
cancel the license and revoke development?
5. If a church was built on someone’s land contrary to Cannon Laws and without permission of
legal owner, can the court revoke the license for operation of those churches?
6. Cemeteries have been established on people’s land contrary to government law or customary
law, and contrary government infrastructures and dead bodies have been buried on farm land
not approved by the law, can those bodies be exhumed and disposed in the right registered
cemeteries? Are those connected to the illegal burials be charged by court of law?
7. Where a road has been constructed without following the original road map on someone’s
land without the directive or knowledge of the land owner and there is no map showing the
approval of the development and the government never paid compensation, can the legal
owner establish a barrier and begin to charge fares for the road users?
8. Is it legal for the public to make and develop a sport field on someone’s land without any
legal document or authority? Can the land owner establish and file a case against ministry of
culture and social services for unfair deal?
9. A Kenya Power and lightening company installs electricity post and transformers destructing
trees which constitutes to environmental degradation with force against the legal land owners,
can the company be charged in a court of law for the damages and bulldozing?
10. Water distribution pipes are buried 6 feet below the accessible level on people’s private lands
where the projects have been funded by donor’s agencies but land owners where the pipes are
accessed are not allowed to use the water and they are tax payer, is it legal to deny those
people access or natural resources?
11. Where people have been unable to prove ownership of land in a court of law, they
have gone ahead to construct permanent fences and fitting security C.C.T.V wires as a
security measures and the question is whether the approval of private security allows a
grabber to establish security measure in a land that belongs to another person lawfully?
