Bring Jaxon Gilmore Home
This petition is concerning Jaxon Gilmore, a young child whose prognosis is unknown. Jaxon was born prematurely and was diagnosed with a catastrophic form of epilepsy at the age of four months, with infantile spasm. He has cerebral palsy (CP) among other diagnoses.
Jaxon’s maternal grandmother, Jessica, has come forth for him, yet the Connecticut Department of Children and Families (DCF) is blocking her from caring for her grandson. Two years ago she was diagnosed with post traumatic stress disorder (PTSD) after the sudden and tragic loss of her daughter. Many people world wide are diagnosed with PTSD. Jessica adopted her granddaughter from DCF who is in her care without CPS concerns or inquiry. The child thrives in all her settings. This child has a family member ready, willing and able to step up and provide the necessary care! There is no excuse for not placing him with family! It seems that Jaxon is possibly being held for the funding he can bring to the state from contracts with certain hospitals and providers. This is not a rare case as we saw exposed in the Justina Pellitier case.
Referencing 42 U.S.C. § 671(a)(19), in order for States to receive Federal payments for foster care and adoption assistance, Federal law under title IV-E of the Social Security Act requires that they “consider giving preference to an adult relative over a non related caregiver when determining placement for a child, provided that the relative caregiver meets all relevant State child protection standards.”
A prolonged seizure can take the life of this precious child - and if this sweet boy is going to die, he deserves to be surrounded by the love of his family. Jaxon’s grandmother adopted her young granddaughter less than 2 years ago in the State of Connecticut with no issues whatsoever, despite her diagnosis of PTSD. There is absolutely no reason Jaxon should not be allowed to come home simply because he is deemed Medically Fragile and his grandmother has been diagnosed with PTSD. In addition to true, unconditional love and nurturing, his grandmother is prepared to step up and provide whatever care is necessary for Jaxon. In the short time he has been on this Earth, she has more than proven that she will go to any lengths to make sure this child is loved, cared for and protected.
I stand with her in taking this issue public. When a parent is unable to take care of a child, there is no one who can love that little one as well as a grandparent! This family is under extreme stress to think that Jaxon might die and not be in his home. It is very cruel for the system to even contemplate separating this family. I have rarely seen such dedication and love anywhere as I have seen with this grandmother to her grandchildren and her children, and Jaxon deserves to feel this love each and every day! He deserves to have a loving and committed grandmother in his corner - fighting tirelessly day in and day out to ensure he receives not just an abundance of love, but that his medical needs are met - needs which are NOT being met under the current circumstances.
