Government: Force Terminix to Honor Its Termite Guarantees
The Issue
The government should stop rate increases of 300 to 28,000% that Terminix is using to run-off longtime customers whose homes the Company failed to properly treat to prevent subterranean termites. Express your support for the State governments to sue Terminix to make the company do what it promised in its guarantees.
Throughout the Gulf Coastal Region, Terminix is either canceling termite prevention guarantees that are renewable for the lifetime of the property - or raising annual renewal fees so high that customers cannot afford the charge. Tens of thousands of customers in South Alabama are being run-off.
One customer paid Terminix for her lifetime renewable termite bond since 1972. This year they cancelled coverage without any notice. Now at retirement age, she is without coverage if her home is damaged.
A church saw premiums increase from a few hound dollars to $73,000 per year. Homeowners see increases in annual premiums from a few hundred dollars to $1,500 or $3,000 – or even more.
Terminix’s CEO admits that the company wants to escape liability for termite damage claims and the cost of treating the properties like it promised it would in its guarantees. If the customers are gone, the company can escape paying for the damage it caused and avoid replacing incomplete or worn-off termite prevention barriers.
Terminix promised customers that it would provide an initial termite prevention treatment and, at the annual renewal, that it would provide any additional necessary treatment at no additional charge. This means that Terminix would retreat at no additional charge when the chemical wears-off in five to seven years. However, Terminix has a national policy never to replace worn-off barriers. This leaves the home unprotected. Cheating will cause untold injuries to these families and businesses. Terminix says that for unprotected homes, it is not a question of “if” but “when” the home will be infested. By not providing the service it promised Terminix made billions in undeserved profits.
State governments can force Terminix to live up to the service commitment it made to customers under Deceptive Trade Practices Acts.
