Texans challenge the disregard of the laws by George P. Bush

The Issue

Rollover Pass a famous fishing venue connecting the Galveston East Bay and the Gulf of Mexico for over 64 years. Rollover Pass has been under eminent attack by the Texas General Land Officer Commissioner George P. Bush, his pre-successor  Jerry Patterson convinced the state legislature that the pass needed to be closed. 

But hit a roadblock because it was private property, so they enticed  Galveston County with a offer that they could not refuse, "cooperate with us and use or eminent domain or face losing tens of millions of dollars in coastal funding, The county judge Mark Henry told me that they were going to cooperate with the GLO instead of standing up to them. 

Then these two entities worked together in total disregard of U.S. Supreme Court ruling that one entity cannot do for another and took the private property away from the owner. Galveston County used its eminent powers to take the property from the owner with the purpose of needing a park to put on top of the property from the owner. 

Galveston county should know that a Texas supreme court ruling on eminent domain states you cannot use eminent domain for a public use if that use is not greater than the use it already is, which Rollover Pass is.

The TGLO is fronting Galveston Counties legal bills to fight us with a huge legal firm and even paid the County for the eminent domain purchase.

The TxGLO wants to close Rollover Pass against the wishes of thousand of visitors and on Sep 9, has totally disregarded our laws by issuing a contract and stating a fence would be installed at Rollover Pass by the end of the month.  This is a another attempt by George P. Bush to circumvent the litigation this community has in the courts over the Gilchrist Community Association standing in the case and the county's right to take. 

Also a major storm Ilmelda struck chambers, and west Jefferson counties with a record breaking amount of rain flooding many business and homes.  This water runoff flows to the intercoastal canal, and Galveston east bay and much of it exits into the Gulf of Mexico at Rollover Pass, why would the GLO or county want to close a drain that reduces flooding. 

We are pursuing our legal position in the county courts as the law dictates, and we demand that  TxGLO Commissioner George P. Bush, & Galveston County cease on any attempts to fence off this property or interfere with its public use until all litigation has been completed and request your assistance in this abuse of power.

There are now posted hundreds of photos and some videos of Rollover Pass at facebook page “ Save Rollover Pass” just ask to join the group after you have been approved you will be allowed to view the pictures, make comments or suggestions, and view many legal filings on our litigation in both the county and 14th court of appeals.          Here is the link to the GCA's webpage where you can donate to our legal defense fund (button is on the bottom right corner)  We need those funds to pay legal fees to continue to battle with George P.
