The Issue

Introduction:
We, the undersigned, urgently call on the Yavapai County Justice System and the broader public to recognize the severe miscarriage of justice unfolding against Erica Ann Montgomery. Despite questionable evidence, omitted facts, and possible perjury in the grand jury process, Erica now faces serious felony charges that do not align with the actual events. We firmly believe these charges are baseless and seek immediate rectification of the unfair treatment she has received.

Background
Excessive Force and Questionable Arrest:
On November 3, 2023, Erica was pulled over in Sedona, Arizona, for a minor traffic infraction. Rather than a routine stop, the encounter escalated dramatically. Officer Jesse Santos forcibly entered Erica’s car, allegedly without lawful justification, and violently removed her, causing severe distress. Officer Santos’s claim of having suffered a “concussion” is contradicted by hospital records demonstrating no head injury or tissue damage.


Disputed “Crowbar” Allegation:
Despite no officer testifying that they saw Erica wield any crowbar or metal object, the grand jury indictment rests heavily on the accusation that she struck Officer Santos. Further, no physical evidence places a “crowbar” in Erica’s hand. Instead, the alleged tool was found on the ground after Erica was forcibly pulled out of her vehicle.


Grand Jury Misconduct and Withheld Evidence:
The grand jury indictment reportedly contained factual omissions and contradictory testimony. Sergeant Laura Leon—who was not even present at the moment of the alleged assault—gave statements that misled the grand jury. Moreover, crucial exculpatory evidence (e.g., the verified medical report and body-camera footage) was never disclosed, impeding a fair and transparent probable cause determination.


Erica’s Good Faith and Clean Record:
Erica has no prior criminal record. She was simply attempting to drive safely with personal belongings in the car, including her late mother’s urn. Fearing an unsafe stop after being rear-ended multiple times in the past, Erica was understandably shaken by Officer Santos’s sudden aggression.
 
Why This Matters
Fundamental Rights at Stake: Everyone deserves due process and a fair opportunity to challenge misleading or incomplete evidence. When official processes rely on falsehoods and omissions, justice is fundamentally compromised.


Misuse of Law Enforcement Authority: If officers escalate minor traffic situations into violent encounters without accountability, it erodes public trust in law enforcement.


Impact on an Innocent Life: Erica faces life-altering felony charges, potential incarceration, and irreparable damage to her reputation—despite a wealth of contradictory proof about the alleged assault.
 
Our Demands
Immediate Dismissal or Remand of the Charges:
We petition the Yavapai County Attorney’s Office and the Superior Court to quash the indictment based on misrepresented facts and perjured grand jury testimony. Alternatively, we demand a new grand jury presentation that includes all exculpatory evidence (medical records, full dash/body-camera footage, and verified statements of eyewitnesses).


Independent Review of Law Enforcement Conduct:
We request that an impartial investigation be conducted to examine the actions of Officer Santos and other officers involved. The public deserves reassurance that no officer is using excessive or unlawful force.


Transparency in Evidence Disclosure:
All relevant footage, audio recordings, medical records, and officer text messages must be released so that the full factual narrative is laid bare. No legitimate process should fear sunlight and truth.


Respect for Erica’s Due Process Rights:
Erica must be afforded every constitutional protection, including the right to contest questionable testimony, to present contradictory evidence, and to have a fair hearing. We call on the courts to uphold these inalienable rights vigorously.
