Re: Request for Arbitration (R38) In the matter of Miami FC and Kingston Stockade v FIFA, et al.
We, the undersigned players, coaches, adminstrators, and supporters subject to the rules, by-laws and regulations promulgated by Respondant, FIFA, and its subordinate bodies, herewith request a finding in Complaintant's favor, that FIFA be forced to enforce Article 9 of its own Statutes on USSF.
Our principle interest in this matter is a desire to see the sport of football grow to its fullest glory in our nation. The impostion of the 'closed league' described in the Request for Arbitration creates an undue burden on that growth. By declining to enfore Sporting Merit on USSF, FIFA allows an anti-competitive environment in which investment and growth in football is stifled. The gains of what investment does take place go dispropotionately to a small group of investors with well-documented conflicts of interest vis-a-vis the growth of football in the United States.
Assuming the best of intents, the current course is ill-advised. Assuming the worst, it is anti-competitive collusion. Neither is an acceptable option to us. We suffer under the 'closed league' system.
Our request is simple: Please force FIFA to enforce Sporting Merit in the United States, per Article 9 of the FIFA Statutes.
