
Please write the County Planning and Zoning and get everyone you know to write to the County.
The county is again trying to illegally add asphalt plants to nonconforming gravel pits. It is illegal to expand, or add to, and make the land use more "intense" use, when land is grandfathered, and the County Planning department are attempting to change Title 12 wording, to make it legal to add an asphalt plant to any of the nonconforming gravel pit.
AGAIN, totally illegal to do, but they could still pass this and then our lawyer would have to get this UNDONE, costing us, the taxpayers money.
There are over 90 gravel pits in Bonner County, and if this passes, the County could add to ANY of those nonconforming(grandfathered) pits, and it won't be considered expanding, which is illegal.
It’s important we all write to the County about this ordinance and tell them this is definitely an ADDITION and more INTENSE USE of the land.
Legally the county cannot decide what is more intense use of the land, but adding an asphalt plant to anywhere changes the dynamics of the land and adds intensity, which includes noise, smells, traffic, changes in property values and much more.
Its unlawful to “add” or “expand” grandfathered land, and this amendment is attempting to do this.

Here are the details of the amendment:
File AM0008-21 - Title 12 Test Amendment - Bonner County is initiating a text amendment to BCRC 12-336: Resource Based Use Table (amending the table to add to the table and code those changes indicated by underline and red font). Table 3-6 Resource Based Use Table (4) Specified conditions with respect to emissions of noise, light, glare, smoke, odor, dust, particulate matter, vibrations or hours of operation may be prescribed differently from those required in a given district, as to be compatible with other applicable state and federal standards. (21) Batch plant operations shall be located outside of city impact areas. The emissions control system(s) on such batch plants shall be of "Best Available Control technology" (BACT) as generally accepted under relevant industry standards, within five (5) years prior to application.
(22) A Batch Plant shall only locate in an active gravel pit. A batch plant placed in a gravel pit shall be considered a separate, discrete use, and not the increased intensity of a grandfathered use to operate the gravel pit itself.
