If you want to write a letter to oppose the asphalt plant, please send it by Sunday at midnight. Subject needs to include Reconsideration C1015-18 Linscott.
It's important you focus on the illegal aspects of the Linscott gravel pit. For example, the Linscott property was grandfathered and made into nonconforming land in 1981 - Mr. Linscott is not allowed to add upon or expanded after that date. Adding an asphalt plant to the property is expanding and is not legal. Also important, the applicant of the asphalt plant- Frank Linscott - has not been compliant with the laws of Idaho or with Bonner County Comprehensive Plan by his expansion of the gravel pit and has not been compliant with the Department of Lands. As of now, Mr. Linscott has to pay $248,900 plus $10,000 by March 30, 2019 to the Department of Lands to continue operating his gravel pit. The asphalt can only be allowed on an active gravel pit.
On March 22nd, the County Commissioners are only allowing the deficiency regarding nonconforming land use. It doesn't mean other concerns regarding health, noise, traffic, or any other issue cannot be brought up and discussed BUT you will need to associate your concerns around nonconforming land use. Fortunately for us, legally nonconforming land cannot be changed to another more intense use, or cannot be added to change a neighborhood, such as changing our health, our traffic, our outdoor experience - such as more noise or anything which changes the neighborhood due to more intense use.
So when you send your letter, or talk at the meeting, it's important that you focus on nonconforming land use and how the changes of adding an asphalt plant, which will be a more intense use, will change the neighborhood - or your life, and you can explain how it will have an affect on you.
For example, start out with - I understand the Linscott property is nonconforming land use and because of this, any changes to the land cannot be more intense in use, or change the community and I have experienced(or if you haven't experience, then say what you worry about experiencing) .......
