Correct the Incorrect Accident Report Involving a 5 Year Old
The Issue
Our sweet five-year-old son, keen to play with his friends across the street, got onto his toy and began his journey to cross the road while I watched from our driveway. A speeding car took no notice of our boy, not stopping or slowing down. It hit his toy and consequently, his right side, causing him to suffer painful fractures to his tibia and fibula.
What followed was even more heartbreaking, our son was unfairly listed as an unlicensed driver using an uninsured vehicle and hence, put at fault by Highway Patrol Officer Bacote. This judgement was premised on the fact that the car had the right of way and our son had no business being in the road.
Given the fact that, according to SafeKids.org, children below 10 years old cannot yet make the safety judgements needed to safely cross a street, the actions of our boy cannot be reasonably interpreted as his fault. Moreover, NHTSA states that drivers are obligated to stop when they see a child in or near a road, suggesting that the driver involved should bear substantial responsibility here.
This life-altering incident needs to be set right. Let's stand together and pledge to rectify the false report of our son's accident. In the name of justice, I urge you to sign this petition and call for a corrected collision report and a comprehensive investigation into the driver's conduct.
