⚠️ IMPORTANT REMINDER REGARDING PROPOSED DATA CENTERS - UPCOMING TOWN HALL &  PUBLIC HEARING  ⚠️ 

This is a friendly reminder to inform you of two important upcoming events regarding proposed data centers;

1.) Data Center Town Hall Meeting *TONIGHT*

What: Town Hall meeting hosted by the county to discuss proposed Data Centers and the community concerns.
When: January 6, 2025 at 6:30 pm
Where:  Henry County Admin. Building at 140 Henry Parkway Connector McDonough, GA 30253
Notes: Please note, that the Town Hall meeting is nothing more than a ploy to distract us from the Public Hearing that is scheduled for January 7, 2025, at 9:00 am.

2.) Data Center Rezoning Public Hearing

What: Public Hearing to approve an amendment of the FLUM (Future Land Use Map) to allow for Data Centers. *anyone can attend to speak in favor or opposition.* (Case #: ULDC-AM-24-03)
When: January 7, 2025 at 9:00 am.
Where:  Henry County Admin. Building at 140 Henry Parkway Connector McDonough, GA 30253
Important Notes: This hearing will allow the commissioners to change the zoning to accommodate the data centers, and to eliminate the issue of “Spot Zoning”, which these Data Centers will create without the amended changes to the map. Please keep in mind that the meeting was set at a time when most of us will be at work (and the day after the Town Hall). Again this was done in an effort to distract us, as most of us having been working & collaborating together to prepare for the Town Hall. 
It should also be noted based on research that several parcels of land have already been bought by several developers/investors in the area by the Data Centers. These developers/investors are sitting by and waiting for the Comprehensive Land Map changes to be made, as it will pave the way for the developments that they are wanting to build. If this all passes the last of the rural land in Henry County will be forever changed and set on a path of urban sprawl. While, the Town Hall is important, attending the public hearing is more critical than the Town Hall. 

If you are not able to attend the hearing please submit your public comments before noon on January 7th, 2025 to sbraun@co.henry.ga.us. When submitting public comments please make sure to include the legal language we have listed below at the bottom of your letter as it will help keep the doors open for legal recourse.

Legal Language:
An approval by the Henry County Board of Commissioners to APPROVE this rezoning request (Case: ULDC-AM-24-03) for Data Centers and APPROVE the required Amendment to the Future Land Use Map (Horizon 2045), would be unconstitutional and discriminate in an arbitrary, capricious and unreasonable manner between the Citizens and Owners of similarly situated property in violation of Article 1, Section 1, Paragraph II of the Constitution of the State of Georgia of 1983 and the Equal Protection Clause of the Fourteenth Amendment to the Constitution.
Any action subjecting the Property to conditions and or re-classification that do not contribute to protecting public health, safety, and welfare through its re-zoning or re-classification and is inconsistent with the Future Land Use Map and the Comprehensive Land Use Map, also constitutes an arbitrary, capricious and discriminatory act classification and would likewise violate each of the provisions of the State and Federal Constitutions as set forth hereinabove.
