The Issue

The Barclay Act 8:46 has been created to implement new laws that will protect the most vulnerable citizens and to help prevent further police brutality from occurring to those that the police are supposed to be serving and protecting. These rules are part of a living and breathing document and will be amended as needed. WE SUPPORT GOOD POLICE OFFICERS that put their lives on the line for us each day. In fact, my father and father-in-law are both retired police officers. We believe there are more good law enforcement officers than there are bad ones, we are proposing this act as a check and balance for those officers who are not upholding the oath of their position. These laws need to be enacted not only for police officers but judges and prosecutors.

- Police officers will be required to have a 2-year associate degree and a 4-year bachelor's degree. The Curriculum will consist of Social science, psychology, communications, and human interaction
- All police officers will be required to upload their bodycam and dashcam videos at the end of each shift. This national database will be created, monitored, and maintained by the FBI and the Justice Department.
- Anyone can stand 10ft away from a law enforcement officer and video record any arrest and or traffic stop. Civilians cannot be arrested for video recording said arrest or traffic stop. The reason for this (is many bad police officers do not want to be recorded they used the distance to hide their activities by asking the person to move far away by saying the person who is recording is interfering in police activity and the officer uses the distance to cover up any and all illegal acts being perpetrated during this stop or arrest.) we need a defined area. Officers should not physically block any citizen from trying to record.
- Law enforcement officers must wear bodycams, and cannot arrest a person unless the infraction has been caught on the body cam. Body cams and cruiser cams must be on at all times during a shift unless they are taking a bathroom break; law enforcement officers found to be shutting cameras off will face disciplinary actions. If the crime is not captured on camera, it should go to a detective for investigation.
- When pulling over a vehicle, the traffic infraction must be caught on the dashcam; if not, the person is to be released. Too many police officers lie about the reality of a traffic stop.
- When someone is handcuffed, a law enforcement officer has 1 minute to place the person in the police car, before they return to investigating the scene. There is no need to punch or chock hold a person once they are in handcuffs or subdued.
- Police must give an announcement through loudspeaker and give 30 minutes or more for a crowd to disperse prior to using gas, rubber bullets, horses, or dogs to break up a protest. There shall a handoff approach unless the law is broken
- Prosecutors are required to bring charges to law enforcement officers who have broken the law; if the prosecutor refuses to bring charges within 15 days, they risk forfeiting their immunity and/or position. The reason this is needed is that when investigations are drawn out or charges are not filed it gives time for statements to be changed, evidence to go missing, and cover-ups to be done. We believe that if charges were filed immediately in the case of the death of George Floyd, then the amount of damage and violence that has happened because the pursuit of justice would be underway.
- Law enforcement officers in all agencies at all levels will be required to undergo mandatory training on a yearly basis (training will be for 30 days) sensitivity and diversity training. The training will cover interactions regarding people of color, religion, disabilities, and people with mental and cognitive health issues. Training will be for 30 days, the entire last week of training will cover race relation issues. The training will be rolled through the entire precinct in each department. It is painfully clear that police officers need training in all of these areas.
- Create a division in each FBI field office that is responsible for reviewing complaints from persons who were arrested by law enforcement officers and the arrest resulted in a false arrest and time in jail. The FBI must investigate all complaints and claims. (in the last century, the review boards for the police have done nothing to investigate and review complaints against law enforcement, and the accusations that have been reviewed have resulted in inadequate resolution of the complaints. It has been proven that the local police cannot investigate themselves, the only way to prove that there has been any violation against a person’s civil rights, there needs to be an investigation by a neutral federal party.)
- DataBase- a national Database will be created to track bad law enforcement officers. Law enforcement officers with multiple infractions or cases of extreme force will be documented in the database. The law is needed to ensure that bad officers do not move from one agency to another.
- Enforcement officers will be required to work in the community they live in. Law enforcement officers should not live more than 20 miles from the area they serve. Law enforcement officers should be a part of the community they serve, they should have interactions with the people they are serving and protecting.
- Law enforcement officers cannot remove a person or ask a person to show ID unless the manager of the apt or homeowner asks to remove a said person, cannot be done by a neighbor. A citizen cannot be detained coming or going from public roads, by a law enforcement officer unless a crime has been committed.
- Law enforcement officers cannot stop people unless an active APB is sent out by dispatch, and all the criteria are met, showing the exact car, color, and area that the crime happened in. If a law has been broken or a crime has been committed, it should be in the bulletin. If the offense is not captured on camera, it should go to a detective for investigation.
- Law enforcement officers can not fabricate reasons for arresting someone- i.e., you cannot be arrested for disagreeing with a law enforcement officer, you cannot be arrested for talking back to a law enforcement officer. A number of officers will create a reason to arrest an individual when there has been no law broken or crime committed.
- Law enforcement officers cannot tell citizens where they can and cannot go if a person is not on private property. The police have a habit of telling people that they do not belong in an area when, in fact, they are a member of the community and are in an area where they are allowed to be.
- Law enforcement officers cannot ask for ID unless those persons are committing a crime. The police have a habit of asking minorities for ID, hoping to catch them in some sort of wrongdoing.
- A person may decline to show ID unless a law has been broken. If there has been no crime committed or law broken, then it is harassment for an officer to request ID.
- Any law enforcement officers found to have ties to racist groups will be terminated immediately and they forfeit their pension and retirement plan. Any personnel who is aware of this and has not reported this information to their supervisor will also be subject to disciplinary actions up to and including termination.
- A police officer cannot be terminated for reporting a fellow officer that used excessive force or misconduct. If the office is terminated or needs to report harassment or retaliation they will file a report with the FBI. All officers that have been terminated due to filing a report of misconduct against another officer will be given 1st priority to be hired by the FBI team.
- No more no-knock warrants for raids. The Breonna Taylor case is not the first case of police entering the wrong house to execute a warrant and a civilian being killed. In these situations, the cost of civilian life does not justify the use of a raid. There needs to be better communication and verification of persons and locations prior to the execution of a raid.
- Bad reviews -What we are noticing that bad reviews are being left on the business of color even though nothing has been purchased or even visiting that said store. Pass a law that makes the review company customers (like yelp) only leave a review if they have purchase something from that store. Also, former employees can not leave a review as well.
- Guns only as a last resort. When confronting an UNARMED civilian, Police must make every effort to use their tazer FIRST to subdue the suspect. Guns are to only be used when the suspect has a gun of their own.
- Evaluation. All active-duty police officers must be required to be psychiatrically evaluated by an independent psychiatrist at least once every 6 months. This will help determine an officer's mental state and hopefully stop these travesties before they occur. Any officer that fails to comply with this guideline will be suspended from the force without pay until they take the exam. Once they are cleared, they can be restored to the force immediately.
- Insurance. All police officers must have professional liability insurance as a condition of employment, make them pay for their mistakes. No more tax-payer funded Civil Settlements.
This is the first of many petitions that we will be launching, this one is covering mostly police. We plan to launch petitions regarding education, healthcare, business, and also the entertainment and other industries that we have noticed need change.
