

It is no secret that the Due Process Deniers want to eliminate the Presumption of Innocence and instead impose a Presumption of Guilt. You can only imagine their outrage when the new Title IX regulation went into effect last August that mandated the Presumption of Innocence and impartial and fair investigations.
In short order, several self-styled victim advocacy groups filed lawsuits to block the Rule, including the Victim Rights Law Center. The Center claimed that women would suffer a disparate harmful impact from the new regulation.
This past week, Judge William G. Young issued a historic decision that vindicated nearly every disputed provision in the regulation.
In addition, the judge called out the legal deficiencies in the VRLC lawsuit, which claimed that the regulation is based on the "discriminatory and baseless gender stereotype that women and girls lack credibility when reporting sexual harassment."
Judge Young quickly rejected this argument, noting that the plaintiffs failed to cite “even a single sentence in the nearly 300,000-page record that supports this accusation.”
This decision was as good a result as we could have reasonably hoped for. You can read a good summary of the decision HERE.
