Almost entirely this is a matter of consumer protection. Most notably the abusers of this current loophole in our laws is the Gaming Industry. Many of it's outlets do not offer refunds for products after they are opened, or in the case of digital content - once purchased all sales are final. There is absolutely no recourse for people to get all their money back for a product that fails to meet their expectations, or if they simply made a purchase they shouldn't have. You cannot even judge a game until the product has been opened! At this time, through the use of things like Game Stop, or the various outlets the internet has for eCommerce to recoup a fraction of the total cost spent on the product.
