Demand the Resignation of Concord Township Solicitor, Hugh Donaghue
The Issue
Concord Residents’ Petition Demanding the Resignation or Termination of Township Solicitor, Hugh A. Donaghue
Concord Township Solicitor Hugh A. Donaghue admitted in a public meeting on Dec 16 that he was involved in the misrepresentation of interested parties in the filing of a brief and other papers to the PA Supreme Court. Donaghue, desperate to protect the supervisors’ current power structure and prevent residents the opportunity to vote on a change in structure, admitted that the brief to Pennsylvania’s highest court, which was purportedly filed on behalf of the seven Concord residents who comprise the government study commission (GSC), was done so without their knowledge or consent.
Study commission members stated publicly, in the Dec 16 meeting, that they had no advance knowledge of these court filings and that they had not given their consent to have Donaghue represent either the GSC or its members in any respect.
Donaghue admitted that he had arranged for another attorney, J. Michael Sheridan, to file those documents with PA Supreme Court and to claim that he represented the GSC and the seven Concord residents who comprise the GSC. The GSC declared in the meeting that Sheridan did not represent either the GSC or the commissioners and that the GSC had never assigned nor engaged Sheridan or any legal counsel. Nevertheless, Donaghue urged the GSC to retroactively affirm his and Sheridan’s actions (i.e. to re-write history) but the GSC members refused to do so.
Donaghue represents other private parties, including Dominic Pileggi and Kevin O’Donoghue, in this same case before the PA Supreme Court. Donaghue used his position as Concord Township Solicitor to disguise the positions and interests of his private law practice clients as those of GSC members. We believe that this is not only is this misrepresentation of the interested parties, but it is an abuse of his office and a violation of his responsibility to serve the interests of the residents of Concord Township. Accordingly, residents should demand Donaghue resign or that the Concord Board of Supervisors terminate him immediately.
As a resident of Concord Township, by signing this petition I demand that Hugh A. Donaghue either resign or be terminated immediately as Concord Township Solicitor.
