Petition for "Endo" (end of contract) to be refuted
The Issue
In order to understand the aim of this petition we must first know what Endo is and how it affects an employee's life.
According to asiapro "end of contract or endo refers to the scheme that corrupt companies exercise to abuse their workers. In the Philippines, the law requires companies to regularize their workers after six months. Unfortunately, some corporations terminate their workers a month or two before their sixth month of employment. Why? Because this means that they do not have to regularize those workers. Instead, they just hire then terminate their contracts within this five-month period and continually repeat this process to create a vicious cycle of ‘end of contract’ or ‘endo."
Regularize workers indicate more benefits than the contractual workers. These benefits include SSS, Philhealth, and the Pag-ibig housing fund contribution, unpaid leaves, and the 13th Month Pay. According to wikipedia "since the initial drafts of the Philippine Labor Code up until today, there has been no drastic action on contractualization. This topic on Endo has been the subject of many debates ranging through various presidencies each promising to end this exploitative labor practice with each presidents contribution being a minute change to the Philippine Labor Code." There are some who believes that this practice is exploitative and illegal while some believes that it is essential to economic growth. Despite its history having made the practice legal, later revisions to Philippine Labor Laws have deemed the practice illegal. However, despite the controversy it is still regularly employed by major companies in the Philippines to cheapen labor fees.
How does this contractualization affects the employees? It affects the employees for the very fact that they have to look for another job, undergo interviews, and pass resume all over again just because their previous company can not make them as a regularize workers for it will cost higher labor fees. For this reason, a lot of good workers seem to be wasting their talents and skills in looking for another job instead of continuously working as a regularize worker. It also eats up much of the applicants time. Imagine, you applied for that company, you waited for their calls, it took a lot of working weeks to finally hear back from them that you got the job, then after working for five consecutive months they decided to fire you. During the time of our former president Ferdinand Marcos, employers are allowed to hire people under a probationary status for up to six months. This months are the trial period for the employers to see if the employee is qualified for the job. However, as time goes by it's legal loophole was spotted by companies and since then has been used as a main basis for laying off workers in order to avoid extra costs for regular employment.
For me, endo can also lead to brain drain. Due to not having a stable work, employees are force to migrate and look for a better job out of the country in which they are stable. According to philstar.com, during the labor day (may 1, 2018) President Duterte emphasizes that the abusive employers have their days numbered by signing an executive order on prohibiting illegal contractualization. “I have warned you before and I warn you again, stop endo and illegal contractualization. I will see to it that our laws are strictly enforced. The government will not rest until we end this shameful labor practice,” the President said.
In order for all of this to stop, congress needs to enact a law amending the Labor Code and come up with a new labor code to keep it attuned to the realities of our times.
