COMMUNITY PETITION TO RESOLVE CONTINUOUS GUNFIRE AND PUBLIC SAFETY HAZARDS IN THE MOBILE POLICE JURISDICTION FOR THE SURROUNDING RESIDENTIAL NEIGHBORHOODS: WINDTREE, THE MEADOWS, ASHLEY ESTATES, SAYBROOK, OAK BRIAR
To: The Mobile County Commission, the Mobile City Council, Mobile Police Department and the Mobile County Sheriff's Office.
WE, THE UNDERSIGNED RESIDENTS, PROPERTY OWNERS, AND CITIZENS of Mobile County, Alabama, residing within the Mobile Police Jurisdiction, hereby submit this formal petition regarding the property located at:
Location and Business Owner : PF5 Development LLC, 0 Schillinger Rd S Mobile AL 36695, 3505 Schillinger Rd S Mobile, Al 36695, Parcel # 33.04.18.4.000.001.238; 33.04.18.3.000.001.xxx; 33.04.183.000.001.098;33.04.183.000.001.096 and 33.04.18.2.000.001.047
PRIVATE NUISANCE (2025 Code of Alabama, Title 13A, Chapter11, Article 1, Section 13A-11-7) (Explained meaning by Supreme Court of Alabama: Baldwin v. McClendon and Parker v. Ashford)
For an extended period, the owner and guest(s) of the target property have engaged in continuous, excessive, and unrestrained discharge of firearms. This activity occurs at unreasonable hours, with high-frequency repetitions, and without adequate safety containment.
This conduct directly inflicts severe harm upon the surrounding community by:
1. Destroying the Right to Quiet Enjoyment: The extreme decibel levels penetrate neighboring homes, disrupting basic sleep, daily living, peace, and mental well-being. Gunfire triggers an involuntary response by jump scare effect, chronic hypervigilance, Trauma and PTSD. For pets it can create severe noise phobia, flight and fight injuries and long term behavior damage.
2. Creating an Active Public Safety Hazard: The absence of verified, professionally engineered ballistic backstops creates an immediate risk of ricochets, stray bullets, and property damage to nearby residential structures and residential pets.
3. Depreciating Property Values: The ongoing, unchecked noise and safety liability tangibly devalue the surrounding residential neighborhood.
DEMAND FOR OFFICIAL ACTION AND LEGAL ENFORCEMENT Because local law enforcement agencies have repeatedly declined to enforce municipal codes Section.62-1.-Discharging firearms, air guns, etc. within the POLICE JURISDICTION, we demand the following actions under Alabama state law:
1. Investigation of State Law Violations: We request the Mobile County Sheriff and Mobile Police to investigate the target property for Reckless Endangerment (Ala. Code § 13A-6-24) based on the volume, direction, and safety infrastructure of the firing.
2. Land-Use and Zoning Review: We request Mobile County and City planning officials to audit the property to ensure it is not operating an unpermitted, illegal commercial shooting range or training facility or hunting.
3. City of Mobile Code Enforcement Division: Hold business in compliance of code Section 62-1 and apply civil and administration sanctions.
4. Neglect Security and Failure to abate a known hazard: Have the Mobile City Attorney's office to issue a formal civil cease-and-desist order to the property owner for maintaining a public hazard.
