This petition is to address the NEED for immediate medical attention for drug withdrawals and a mental health evaluation, by a licenesed professional to assess inmates who are arrested for drug possession and use. We would like to have a Federal Mandate for immediate medical attention and necessary medical treatment for inmates who are arrested for drug possession or drug use.
The War on Drugs needs to be addressed with a different approach.
Many times in our communities when a drug addict is arrested, they are using and have been using for a while.When they are locked up, they are going to go through withdrawals, from not using. MANY times, the police are the first to have contact with the addicts through arrest. This is the BEST opportunity our police could have to help with the war on drugs. With the help of Medically trained personnel to assess the inmates, they would be able to start treatment immediately and get relief from the withdrawals they're going through.
Some states have measures in place for addicts to receive medical attention for the withdrawals that WILL OCCUR from not using the drug of choice.Some states leave it up to the individual counties to put the medical requirements in place.THAT is where there lies a "grey area".
The assessment of an individuals mental health or physical health is left up to deputies and intake officers who are not medical personnel. They are not always "attuned" to or aware of the physical or mental conditions of inmates.
The Hein Family can attest to this. On January 16, 2017, Ryan Hein was arrested, and taken to the La Porte County Jail in La Porte Indiana, for a possession of 3 used and 2 unused syringes and a prior warrant for possession of cocaine. The local county deputies made an assessment of Ryan and decided that he didn't need any form of medical or mental health attention, since he "gave no indication" that he would possibly harm himself. On January 20th, Ryan was found in his jail cell, a victim of suicide. Ryan had allegedly told the police, "That drug is the devil, and I'm trying to do it for my kids, but it's just too hard". Ryan Hein suffered in silence and the jail personnel didn't have the ability to see that he was going through withdrawals.
This petition is to address the NEED for immediate medical attention for drug withdrawals and a mental health evaluation by a licenesed professional to assess inmates who are arrested for possession of or use of drugs. To make it a Federal Mandate to require ALL jails to provide immediate medical and psychological treatment for drug users after arrest.
This would help eliminate the possibility for suicide in jail as well as covering a broad spectrum of other issues related to drug addiction/recovery, lower the probability of litigation from TORT cases, and lower the recidivism rate for repeat offenders.
