Cobb Planning Commission: Don't continue industrial uses Z-52
The Issue

At the Board of Commissioners zoning meeting on 06/18/24 the 2.88 site on Shallowford Road was given a proper commercial rezoning, Neighborhood Retail Commercial for retail and office use only. No contractor uses allowed and the site must come into compliance within 60 days. There were also many other stipulations (requirements).
The site had become a blighted nuisance with 4 unlicensed businesses operating illegally on residentially zoned land. This had gone on for years unnoticed by Cobb authorities. It is also adjacent to a neighborhood.
Hopefully this will clear up the problems soon.

The Board of Commissioners will hear the case on JUne 18th at 8 am.
We the undersigned residents are opposed to certain conditions of rezoning case Z-52 at 1022,1028 and 1054 Shallowford Rd. which were proposed by Attorney Kevin Moore.
We agree that the property needs to be rezoned to NRC and cleaned up. Some of the existing uses will have to be discontinued and others will have to be modified to comply with the zoning ordinance of NRC.
We ask for the following stipulations:
CRN would support rezoning Z-52 to NRC for Neighborhood Retail and Professional Offices only
subject to the following:
- No boat or RV storage
- No Special Exception uses
- No automotive uses, including light automotive repair on parcels 16020400020, 16020400010, 16020400600
- Light automotive repair at 1054 on parcel 16020300020, all work to be indoors,vehicles to remain inside while being repaired.
- No convenience store with fuel sales
- No pawn or title pawn
- No outdoor storage
- No heavy equipment
- Landscaped buffer along the southern property line, a minimum 20’ to include evergreens to achieve a height of 6’ within two years.
If a Special Exception use is approved by the BoC, the landscaped buffer shall be not less than 35’. - 8’ Vinyl chain link fence
- Sidewalk, curb and gutter along Old Shallowford Rd frontage within 1 year of BoC approval.
- Hours of operation M-F 8 am to 6 pm, Sat 8 am to 2 pm, Sunday closed
- No overnight parking is permitted except for minivans and cars.
- Dumpster size 6 yard, for office waste only, on parcels 16020400020, 16020400010, 16020400600
- Dumpster to be enclosed and screened from view
- Lighting shall be contained to subject property
- Parking must be on a hardened surface
- Sheds encroaching to the rear setbacks to be removed
- Junk or inoperative vehicles or vehicles without current tags to be removed
- Old wood privacy fencing to be removed
- 15’ fence with landscape screening on southern property line to be removed
- Roll off dumpsters and plastic bins to be removed from site
- No overnight parking for tractor trailers or dump trucks (heavy equipment over 12,500 lbs.)
- Suggest fencing be constructed along the east border of 16020400020 and 16020400010.
- Any revision to site plan or amendments to stipulations shall come before the BoC as Other Business.
- A date certain to cure code enforcement violations and to address fencing and landscape buffer on southern property line.
While there are many requested stipulations, they are needed to remedy the harm done to the adjacent residents on Judy Ann Lane. If these stipulations are carried out, they would make the property more marketable, cleaned up with a viable zoning, and potential assemblage. The stipulations move the property away from its improper heavy industrial uses and create the potential for many more benign, neighborhood friendly uses. Ultimately this would benefit the current landowners as well as the residents on Judy Ann Ln.
