Clarify Vague Verbiage

The Issue

There is a loophole in BOP/DOC policies that violates the 8th & 14th amendment & allows incarcerated individuals to be placed in solitary confinement and held under investigation for undefined periods of time.  This is based on vague language such as “timely manner” "without delay" and “reasonable time.”

These terms are not clearly defined, yet they are used to justify medical treatment, investigations, prolonged confinement, delayed hearings, and disciplinary actions without proper accountability.

This lack of clarity creates a dangerous gray area that allows constitutional rights to be violated; particularly the right to due process & deliberate indifference under the Eighth and Fourteenth Amendments.

Individuals are being refused emergency medical assistance along with being held in segregation:
- Without clear timelines for investigation  
- Without prompt hearings  
- Without sufficient evidence  
- And in several cases, in retaliation for exercising their legal rights  

When policies rely on undefined terms, they allow subjective interpretation by prison officials, which can lead to inconsistent, unfair, and even abusive outcomes.

This must change.

We are calling for:

1. Clear, enforceable timelines for investigations and disciplinary hearings  
2. Defined limits on how long an individual can be held in solitary confinement without formal charges  
3. Mandatory documentation and transparency in all disciplinary actions  
4. Accountability measures when timelines are violated  
5. Independent oversight to prevent abuse of discretionary language. 

Solitary confinement is not a minor administrative tool, The United Nations has deemed it torture if exceeding 15days. It is a severe form of punishment that can have lasting psychological and physical effects. Allowing it to be governed by vague language invites misuse and undermines the integrity of the justice system and The Constitution of the United States.

No one should lose their rights because of undefined words. 
This vague language is used in medical settings as well and has created a space for gross negligence, near death experiences and in some cases, death.

 

We the people demand clarity. Demand accountability. Demand justice.

Sign this petition to push for reform and protect the constitutional rights of incarcerated individuals & their loved ones. 
This will also reduce the amount of lawsuits  prisons & hospitals are paying out for violating someone's constitutional rights.

We know the president loves to save money in this country, every state in America has paid out millions in grievances due to the abuse of authority and power caused by this vague verbiage.
