There have been some developments over the past two days in Rusty’s case. Essentially, City of Dallas is challenging Judge Stoke’s decision to allow Dallas Pets Alive to move forward with the appeal process in Rusty’s case.
From Cherie Batsel, attorney for Dallas Pets Alive - “The City of Dallas continues to expend taxpayer dollars in their pursuit of ending Rusty's life. Dallas Pets Alive has offered, at no cost to the City, to place Rusty in an out of state sanctuary for the remainder of his life and yet the City continues to refuse to even discuss the option.
“Dallas' first assistant city attorney five of her fellow city attorneys, whose salaries are paid with taxpayer dollars, filed notice of an appeal to the Dallas Court of Appeals challenging Judge Stokes' denial of their Plea to the Jurisdiction. As this appeal stays all proceedings in the trial court, the hearing scheduled for Friday will not go forward. This appears to be yet another attempt by the City to drag out the case as long as possible perhaps hoping Dallas Pets Alive, its legal team and Rusty's supporters will tire of the fight to save Rusty.”
From Dallas Pets Alive – We are pleased to announce that highly regarded animal law attorney, Donald Feare, has joined our pro bono legal team in the fight to save Rusty’s life. Feare teaches animal law at Texas A&M University Law School and is widely considered a top animal law expert. Most recently, he was part of the legal team in the successful Lamb of God case. We are grateful for his assistance in what is unfortunately becoming an unnecessarily lengthy battle.
We are also very thankful for the continued, persistent efforts of our team of legal experts who have worked tirelessly over the past month to help us in our fight for Rusty.
