We are pleased that Judge Stokes is allowing Dallas Pets Alive to proceed in its fight to save Rusty. Dallas Pets Alive continues to offer the City of Dallas a positive solution that meets the needs of all parties and we remain hopeful that we can reach an agreement on this matter. In addition, we have expressed our willingness to work with the City and Dallas Animal Services to establish uniform policies and procedures that would ensure due process and fairness in the handling of such cases going forward.
There is a hearing on Jan. 26 where Dallas Pets Alive will ask Judge Stokes to grant a temporary injunction, which essentially would extend the restraining order currently in place prohibiting the City of Dallas from killing Rusty until an appeal can be completed. The County Clerk is still waiting on documentation from the Municipal Clerk in order to process and officially begin the appeal. Until such time as the appeal moves forward Dallas Pets Alive will continue asking for injunctive relief to ensure no permanent action is taken against Rusty.
We sincerely thank the community for their continued support of our fight for Rusty’s life and would like to remind Rusty’s supporters that Dallas Pets Alive has maintained that neither the child nor the dog should be blamed for the incident. We urge the community to remain positive in any outreach done on behalf of Rusty or Dallas Pets Alive. Please continue to contact your City Council member and other elected City officials.
