We have not yet received a ruling from Judge Stokes on the City of Dallas’ Plea to the Jurisdiction, but expect a ruling on Monday. The City continues to argue there is no right to appeal Judge Robinson’s order despite clear case law that explicitly allows such an appeal. The City also argues they are immune from suit despite the fact the appeal is from a case the City itself brought against DPA and Rusty. Today, the City of Dallas sent six attorneys to Court, continuing to argue for Rusty’s death when a positive outcome that meets the needs of both parties remains a viable option. We are hopeful the Court sees the error in the City’s arguments and allows the case to proceed. DPA and Rusty are entitled to due process in a fair and impartial court of law.
