As you know, we sued the City of Austin for their refusal to fully enforce Prop B (reinstatement of the camping ban).
We have excellent lawyers working hard on our behalf.
This work requires us to raise and spend resources to keep going all the way to the Texas Supreme Court.
Right now, our lawsuit is before the 3rd Court of Appeals, with the next deadline (for our response brief) set for this Friday, and potentially oral arguments not long after that. We would expect a decision in the next 2-3 months, if not sooner.
The losing side will likely appeal to the Texas Supreme Court and that would be the final decision in this matter.
As you recall, with the help of so many Austinites, we passed Prop B in May 2021 by earning more than 90,000 votes and a vote margin of 58%-42%.
Instead of respecting the will of the voters, the City of Austin has refused to enforce Prop B, which is why encampments are back and the homeless population is growing, according to the city's own estimates.
We joined with four small business owners who have been directly harmed by the city's willful disregard of both city ordinance and state law to file the lawsuit.
But we can't give up now.
We need another $20,000 for the 3rd Court phase and at least another $25,000 for the Supreme Court phase.
