Dear Fellow Citizens, I have begun this petition for a reason and that is "That there are some Judges of the High Courts who are abusing this protection given to them by this Act by Announcing or Passing Orders or Judgments more particularly in Criminal Petitions filed by Accused under the Provisions of Section 482 of Cr.P.C (code of Criminal Procedure) and are found to be giving relief to the Accused by quashing Criminal Cases pending in Trial Courts".

I am a Social Activist, and have been crusading against corruption, it is during this crusade of mine I filed a couple of Criminal Cases against some public Servants for acts of Corruption (Misappropriation, Creation of False Documents, causing death of a person by acts of negligence, omission of duty towards the society)

In two cases the Judge of the High Court passed orders quashing the Criminal Cases pending in the Trial Courts, which were filed on information gathered under the RTI Act of 2005, and where the information received from the MOD GOI, under the RTI stated that the actions of the Accused are a case of Fraudulent Claim of Traveling Allowance and Daily Allowance and hence is a Case of Misconduct in this Case the Justice stated that the claim were made in an Official Capacity and were approved by the superior officers of the Accused, and the pending Criminal Case in the Trial Court was quashed.

In the second case which came before the same Justice of the High Court, the Trial Court took cognizance of offence u/s 304-A against the Accused public servants, the accused approached the High Court filed a Petition U/s.482 praying to quash the Criminal Trial. The Justice once again set the accused free by quashing the Criminal Case stating that since the Accused Public Servants are retired and hence negligence on their part can not be attributed which caused the death of a Patriotic Person ( A Pilot of the Indian Navy). After the Judgment was pronounced I made a representation to the concerned department under the RTI seeking information of the present employees working in a specific department, the names of the accused who the Justice claimed to have been retired from service were shown as presently employed by the department.

These are the types of Orders that are being pronounced by the Judges, because they have made certain that they are protected by the Judges Protection Act 1985.

To ensure that the Law is equal to one and all in this Country in accordance with article 14 of the Constitution of India, this particular Judges Protection Act 1985, should be repealed and the Citizens should also be given the opportunity and the rights to file criminal cases against such Corrupt Public Servants, so that those sitting on the seats of Justice will not dare to pass orders freeing the accsued who have committed crimes and where there are documentary evidence proving beyond doubt the prima facie offence committed by the accused.
