End Multi Unit "Monster House" construction in Enchanted Lake

The Issue

Our neighborhood community is very tight knit and family oriented.  Most people that own single family homes in Enchanted Lake have lived here for many years. When the families bought here we did so because it is a safe and quiet community to raise our children.  For the past few years, foreign investors have been buying up residential properties and building multiple rental units on one property.  We want to stop the construction of these "Monster Houses" in our community!

The latest “Monster House” being built is in the Enchanted Lake neighborhood of Kailua. The lot size is 8188 square feet. They are building 2 large homes on this property. Each home is 2766 square feet. We believe the investors are planning on having 4 separate rentals as the permit states that each home has a full kitchen plus a wet bar.

Unfortunately, this problem affects many neighborhoods all over Hawaii. We must all come together to put an end to foreign investors erecting  "Monster Houses" in our communities! 

We, the community of Enchanted Lake Estates are demanding an immediate CEASE & DESIST to the construction of 1051 Kahili Street and adhere to the “Declaration of Protective Provisions” (DPP), dated September 18th, 1987, recorded in the Bureau of Conveyances, State of Hawaii, in Book 21156, Page 235. The structure is illegal based upon property law under original deed. Every subsequent purchaser of the home are bound by these restrictions in the Enchanted Lake Estate Community.

Section 1 Under Article II Restrictions reads as follows:

All residential lots shall be occupied and used only for residential purposes and only one (1) single-family dwelling (exclusive of outbuildings) shall be erected, placed, maintained or allowed on a residential lot. No building or structure on a residential lot shall be used as a tenement house, rooming house or apartment house or for or in connection with the carrying on of any business or trade whatsoever.

The building does not conform with the Enchanted Lake Estates Community standards.
