The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 31-01-2010 before the PIO requesting to furnish the following points:- 1. How many representations and petitions were received by your office from various plot owners and others in respect of land admeasuring 9 acres of Sy.No.745, 707, and 743 and 5.37 acres of Sy.No.745 of Shamshabad Village during the period from 07-10-2006 to 30-11-2009, give details in the following proforma:- Name of the Petitioner/ representation submitted Address File No. Date Reason for pending 2. Please clarify why your file No. D1/5586/06, dated 08-12-2006 is kept pending since long time as reply letter of Tahsildar, Shamshabad Mandal letter No. D/731/2007, dated 30-06-2007 waiting for further instructions as informed to me vide Tahsildar, Shamshabad Mandal letter No.RTI/34/2009 and letter No. RTI/38/2009, dated 30-12-2009 submitted to your office by Tahsildar, Shamshabad Mandal. 3. Due to pendency of file No. D1/5586/2006, dated 08-12-2006, Tahsildar, Shamshabad Mandal taken advantage of violation of ROR Act by implementing proceedings No. B/3480/2003, dated 23-08-2003 treating it an agricultural land evidenced through your earlier Tahsildar, Shamshabad Mandal letter No. D/731/2007 dated 30-06-2007 containing pahani details since 1955-58 to 2004-2005 and as per this letter plots are mentioned in the position column in the year 2000-2001 against land in Sy. No. 745 & 743 clarifying Non-Agricultural Land Attract section 2(4) of the ROR Act, what is the name of the responsible officer who violated the ROR Act and how you will make good to the plot owners to avoid damages? 4. Our letter dated 05-01-2006 acknowledged by your office on 16-01-2009 informing about violation of Stamp Duty Act in respect of land registrations in Sy.Nos. 707, 743 & 745 requesting you to take action by collecting Deficit Stamp Duty arose on account of agricultural land registration over plots registrations, land violating law. What is the progress made on this letter? 5. Our letter dated 25-05-2009 submitted to your office which is acknowledged on same date under RTI Act for which information is still pending wherein we asked following queries. Please inform a. How defective document No.3166/2003 and its rectification document No. 3502/2003 (Violated Stamp Duty & Registration Act) considered for mutation proceedings as the same land ceases the applicability of ROR Act as per section 2(4). b. How Mutation proceedings of the MRO, Shamshabad Mandal, Ranga Reddy District vide proceedings No.B/3480/2003, dated 23-08-2003 implemented in the revenue records after 30-06-2007 inspite of our representations evidenced through your earlier Tahsildar, Shamshabad Mandal letter No. D/731/2007, dated 30-06-2007. PTO--- -2- 6. Our letter dated 25-11-2009 acknowledged by your office on dated 30-11-2009 vide inward No.17985 where in we requested to take appropriate action of suspension/ cancellation of mutation proceedings of the Mandal Revenue Officer, Shamshabad Madnal, Ranga Reddy District vide proceedings No. B/3480/2003, dated 23-08-2003 till recovery of deficit stamp duty of Rs.29,33,975/- along with penalty under section 41A of Indian Stamp Duty Act 1899 and suspend/ cancel the mutation proceedings basesd on document No. 3166/2003, 3501/2003 and Rectification document No. 3502/82003 of R.O. of Ranga Reddy District till recovery of deficit stamp duty of Rs.29,33,975/- along with intimate/implead in O.S.No.768 of 2009 pending before I Addl. Senior Civil Judge, Ranga Reddy District at L.B. Nagar in respect of DSD document to avoid irreparable damages to 103 plot owners and initiate disciplinary proceedings against earrant MRO for violating the law. What is the progress made on this file? Please inform. 7. Please provide us copy of reply in respect of DRO, Ranga Reddy District proceedings No.A5/RTI/6796/2009, dated 21-12-2009 as we have not received intimation from O/o the Special Grade Dy. Collector & Revenue Divisional Officer, Chevella Division, Ranga Reddy District. 8. With reference to our letter and your office file No. D1/4787/2007 dated 05-01-2009 wherein we informed about overlapping registration of agricultural land over plotted land and requested to safeguard our rights over plotted land to avoid damages to earlier registered plot owners. District Registrar also informed about overlapping registrations vide letter No.7370/G1/2007, dated 23-04-2009. What is the necessary action taken by you on receipt of letter No.7370/G1/2007, dated 23-04-2009? Stating that he has not received the information he filed 1st appeal dated 10-03-2010 before the 1st Appellate Authority /Joint Collector, Ranga Reddy District requesting to arrange to supply the information. The appellant stated that as he did not get the information even after 30 days of filing his appeal, he filed this 2nd appeal before this Commission requesting to arrange to furnish the information sought by him. The 2nd appeal was taken on file. On 27-07-2012 the case was called. Appellant & PIO/ DRO, Ranga Reddy District are present. The case was adjourned with a direction to respondents to examine the appeals in detail in consultation with all concerned. On 15-04-2013 the case was called. Appellant Sri G.Raju and the PIO/ DRO, Ranga Reddy District present. The PIO/ DRO, Ranga Reddy District stated that the Tahsildar, Shamshabad has already furnished the information through letter dated 14-05-2009. The Commission perused the application dated 31-01-2010 in which the appellant by submitting the details of the report of the Tahsildar, Shamshabad, submitted through letter No.D/731/2007, dated 30-06-2007, 30-12-2009 and 23-08-2003 requested the PIO to furnish the information in respect of eight items sought for there in. The Collectorate of Ranga Reddy District acknowledged its receipt on 02-02-2010 and also appeal dated 10-03-2010. But the PIO/ DRO has not furnished any information to the appellant. Therefore, the PIO/ DRO, Ranga Reddy District is directed to furnish the factual position to the appellant on the application dated 31-01-2010, within two weeks from the date of receipt of the order and report compliance.
