Change Revenge Porn Laws
The Issue
In 2018, my nudes were shared on Facebook by my ex-boyfriend, causing immense trauma. Hi, my name is Queentah Naliaka Wambulwa, a survivor of revenge porn and now a cyber-gender activist. These images circulated within my family and school, leading me to grapple with depression and suicidal thoughts.
Regrettably, my struggle for justice continues, highlighting a pressing issue: the rise in technology-facilitated violence, including non-consensual pornography, 'sextortion', cyberstalking, and doxxing, severely impacts the victims emotions, reputation and even physical well being.
The existing legal framework in Kenya falls short in addressing these crimes. While other digital offences yield substantial penalties, survivors of online violence face barriers to justice. The Computer Misuse and Cybercrime Act of 2018 did criminalize the posting of intimate images without consent, but the penalties are insufficient. It's unjust that someone found guilty of music copyright infringement faces harsher consequences than those perpetrating non-consensual sharing of intimate images. This discrepancy undervalues the safety and dignity of women and girls in Kenya.
Because of this, the petition demands that:
- The National Assembly and The Judiciary Implement The Criminal Justice and Courts Act that states, "A person who, individually or with others, intentionally discloses, communicates or distributes the image of an identifiable person in a state of nudity or engaged in sexual activity, when the person has an expectation of privacy, with the intent to harm, harass, intimidate, threaten, or coerce the depicted person, commits an offence and is liable, on conviction, to a fine not exceeding seven million shillings or to imprisonment for a term not exceeding five years, or to both.”
- The National Assembly in concert with the Ministry of Information, Communications and The Digital Economy Implement Data Protection Act 2019 that states “Sexually explicit photos of individuals are "sensitive personal data," and the subjects of such images have the right to request that any processing of such data cease if it is causing or is likely to cause serious harm or distress. If this legislation has been broken, the victim may file a lawsuit for damages and ask for an injunction to stop anyone from accessing the image."
