Challenging the unlawful shutdown of our school GSA (Gender and Sexuality Alliance)
The Issue
The shutdown of our school's GSA is not only unjust but violates our constitutional rights, specifically the First Amendment which guarantees freedom of speech and association, and the Supremacy Clause, which ensures federal law overrides conflicting state law. Equal protection and support for LGBT+ students is a fundamental right recognized at the federal level, and our state should not impose restrictions contrary to these principles.
To provide some context, GSAs are proven to be beneficial for students, offering significant benefits in terms of emotional wellbeing and academic performance. According to the Gay, Lesbian & Straight Education Network (GLSEN), students in schools with GSAs tend to experience less victimization and discrimination, and enjoy a more welcoming and affirming school climate. Denying students a GSA goes against these positive outcomes and is detrimental to their health and academic success.
We understand the importance of respecting state regulations, but it must never come at the expense of marginalizing or silencing our student body’s diverse voices and experiences. We believe in an inclusive and equitable education system that honors ALL students. Shutting down the GSA is a step backward and tells students needing support that they are unwelcome.
We call upon our school district to reconsider this decision immediately and to provide a clear pathway for the reinstatement of our GSA. By doing so, they can demonstrate their commitment to upholding the rights guaranteed by our Constitution and to fostering an inclusive environment for students of all identities.
Please join us in demanding justice and equality. We urge you to sign this petition to ensure that our school recognizes the vital role of GSAs and our community’s rights, pushing for a reversal of this decision and the upholding of federal and constitutional laws for the benefit of our students and their futures. Together, let's stand against discrimination and for the empowerment of every student. If the district and state refuse to change the law, we will take this to court.
