SEC vs Plexcoin An Investors View

The Issue

For The Attention Of US SEC and The Autorité des marchés financiers (AMF).
 
 
In December 2017 The SEC’s complaint charges Lacroix, Paradis-Royer and Plexcorps with violating the anti-fraud provisions, and Lacroix and Plexcorps with violating the registration provision, of the U.S. federal securities laws.
 
This being the first high profile case of the newly formed Cyber Unit of The Securities and Exchange Commission. Headed by Mr Robert Cohen.
 
Your complaint included the following:
 
PlexCorps marketed and sold securities called PlexCoin on the internet to investors in the U.S. and elsewhere, claiming that investments in PlexCoin would yield a 1,354 percent profit in less than 29 days
 
The above statement has been deliberately misinterpreted on a number of occasions and I/we as investors have never assumed or been promised these gains.  The actual statement I have on my computer reads:
“This calculation tool relies on the pricing scale of the first sale level, which will be activated on the pre-sale launch (US$0.13 per unit). The evaluated value (US$ 1.76 per unit) relies on the possibility that all of the PlexCoin are sold within the pre-sale period. If this is the case, your initial purchase will be multiplied by 1 354% in 29 days or less. (REF: 06)”
I do not believe the above statement to be misleading in any way. It clearly states that to achieve 1,354% profit then ALL Plexcoin need to be sold during the pre-sale period.
I personally am not a professional investor in fact Plexcoin was my first investment, however I have never been of the belief that this would be achieved, and I don’t consider myself as being miss-sold or mislead
Also in your complaint are several referrals to Plexcoin being a “Scam”
I find this to be a little confusing for the following reasons.
I signed up for an ICO and was offered Plexcoin at an initial price of $0.13 I purchased a number of these Plexcoin at that price and I received those Plexcoin into my Plexcoin account along with additional Plexcoin for referral bonuses. On the 2nd Decembers 2017 PLX hit a high of $0.800071 now if I held 10000 PLX at a price of $0.13 ($1,300) and sold them at the high price of $0.80 I would of made $7700.00 in profit. Please tell me how this could be referred to as a “Scam”
 
I/We believe the way in which The Securities and Exchange Commission have handled this case has caused considerable undue amounts of stress and financial loss to thousands of individuals whom the SEC claim to be acting on behalf of.
 
 
We request that the SEC considers the impact their actions are having on ordinary members of the public.
We request that you reinstate the means for Plexcorps to communicate with its investors such as Plexcorps Facebook page which has only ever been used for information and not for selling or advertising.
 
We request that SEC refrain from using the inflammatory word Scammers when referring to Plexcorps, Plexcoin, Dominic Lacroixand Sabrina Paradis-Royer.
 
We respectfully request that provisions are put in place to allow Plexcorps to operate in a support only roll until the case has been concluded.
 
Due to the high volume of negative publicity Plexcoin has received from statements made to the media by US SEC and The Autorité des marchés financiers (AMF). The likelihood is that Plexcoin would struggle to make any future progress regardless to any positive outcome of the current case, I believe a very large number of members would appreciate any notice of intention with regards to the frozen funds currently being held by the courts, and would also like to remind the SEC that these funds belong to the investor.
