Thanks to everyone's support we were successful in getting 1 3/4 miles of access back out of 35 miles of Atlantic facing coastline. Also the Seashore Superintendent George Price will be retiring next month. So I decided at this point to dismiss the lawsuit based on the fact that kiting is no longer banned for 7 mos along the entirety of the Cape Cod Atlantic shoreline as stated in the lawsuit. My goal in this is twofold- in hopes of having a more productive and collaborative dialogue with the new Superintendent while maintaining a good public perception that kitesurfers are not spoiled selfish brats that put their own personal enjoyment ahead of conservation goals. The lawsuit was a last resort following 8 years of meeting with Supt Price and CCNS staff to try and modify the draconian restrictions. They claimed that the prohibition was justified because we were harming threatened and endangered shorebirds but could not provide any proof to support this, apart from saying that they came to this conclusion after some staff observations (which amounted to nothing more than a couple flushing events). Furthermore, decades of annual shorebird management reports failed to reflect these claims which they stated have been negatively impacting the National Seashore for many years. Hence why I felt they should have to prove their claims in a court of law if they were using them to establish public policy for the National Park Service, something they didn't seem prepared to do. And while I am grateful that the underdog prevailed this time (which wouldn't have been possible without the support of all of you), my work is not done as I intend to meet with the new Superintendent once one is appointed, and try to get more access back on the beaches here that have been ravaged by erosion and sea level rise due to climate change, threatening the survival of nesting shorebirds at a magnitude that kites never have. I will continue to work for kitesurfers everywhere, setting US NPS precedence, and meeting with the Feds in hopes of enlightening them that kitesurfing and conservation can go exist.
